hmmm, sorry for posting this 2x.... but this is my first time to this site and new here too .. so not familiar with posting.

Today husband and I get this letter has me really really confused

first box is x'd will only type part of it ...

If you were not required to file a Federal income tax return under U.S. tax law, attach a written explanation and if applicable, evidence of the exemption and why you are subject to it.

my husband gets a 100% non taxable pension from the VA and also an amount from the Social Security which is also non taxable 100% We thought we provided them with enough evidence ... why could they be asking for more??

the 2nd box is xd the petitioner/sponsor income the the federal income tax return does not meet or exceed 125% (100% if military) of the poverty guidelines. The petitioner/sponsor lists their current income on the Form I 864 as an amount to be considered as sufficient, however, no evidence has been submitted as proof of current income ...

Help help help!!!! more confusion ... someone get me out of this confusion we have 87 days to comply.

For the first box- Your suppose to send in the last 3 years of tax returns. Did you send them? If not (because your spouse is exempt from filing because of whatever reason) you need to send a letter explaining the reason why no tax returns were filed. The letter can be handwritten or typed and should explain the reasons why the US taxpayer is legally exempt from filing returns during those three years.

For the second box- Its saying you havent met the income requirements because you listed your income as sufficient BUT " no evidence has been submitted as proof of current income".

So it sounds like you just filed out the form and sent in nothing along with it. You can obtain proof of SS benefits immediately by going to the local SS office or by ordering it online and getting it in the mail in 7-10 days. Im not sure about where to get a statement of VA benefits though.

Thank you Capri ... your answer makes me feel more better. We went to the SS benefits to get a letter of income verification ... and now we're going to phone the VA office tommorow for the letter of income verification ... Also send along statements with deposits and balances that prove where these amounts are deposited .. and basically that is the only income we have is those 2 ... and its well above the poverty line 45 466 ...

I would also submit proof of something that states this income is "non-taxable" or a print-out from the IRS about how these incomes are tax exempt.
