my fiance will arrive in US this november w/ fiance visa. but he also has a petition from his mom. is there anything special we need to do?

hi! my fiance will arrive in the US on nov 16 with fiance visa. his mom petitioned him too. i know that we need to get married and apply for adjustment of status after but what do we need to do with his mom's petition? i'd appreciate your input

What do you mean his mom petitioned him? Or are you saying he wants to petition for his mom? If second is true, then if I'm not mistaken, he cannot yet until he has received his citizenship. I don't believe you as the USC can petition for her at all, it has to be him. But I'm sure someone else will come along and correct me if I'm wrong.

Is your fiance's mom living in US and is an US citizen? When his mother petitioned him? Using what kind of visa? Was that petition approved?

I don't understand why your husband has 2 petitions. If your husband is gonna travel to US under a k1 visa, then why his mother petitioned him? Please give us little more information about your case.

When your fiance arrives in US, he will have to marry you within 90 days of his arrival... Once you both married then the next step is applying for his AOS (GC, AP and EAD).

Regarding his mom's petition, I dont know what would happen with that as he will be already in US. Maybe she should cancel that petition as he already has a visa.

It's either he has an F1 or F2B petition. What stage is the petition in? He or his mother should contact USCIS or NVC and inform them that they will no longer pursue the petition.

his mom is here in the US and she petitioned my fiance to come over here. she did it before i filed the fiance petition..meaning my fiance has 2 petitions. the parent and child type of petition takes years to complete. i just heard that my fiance has to drop the petition that hs mom did for us to have no problem with his adjustment of status
