I really dont know where to post this confusion I have in mind. :bonk: Honestly, its advantage that you have read some VJers experience and thoughts. However, it makes you confuse in some other stuff! lolz. Anyway, for K1 visa you are required that you have met your partner in 2 years span right? but will i get denied if I havent seen my partner for almost 1yr now due to financial and work related? the last time I was with him was December 2011, though he already visited me numerous times from December 2010 up until December 2011. to be exact he came here 4x already. since he got laid off from work, which it is so difficult for him now as he is trying to look for a very good job. We decided that he better yet come see me when the papers are done. to save money and time aswell. so what do u think this can affect the k1 application? many thanks to those who could help me out! :thumbs:

The requirement is that you have met in person within two years of filing the K1 petition. If he was there in Dec 2011, you are good until Dec 2013. There should be no problem.

hahahaha.. thanks a lot davee... this stuff reading too much from other people makes me confuse with what i have... but i think its normal to compare just to be safe right? hehehehe

Yep, normal to worry. Just make sure you have the proof that he was there for your package.

You guys meet the requirments, no problem for you guys. I'm amazed that you just filed your application this month and are expected to have an earlier approval of our application which we filed in July. Be very thankful that your application went to California instead of Vermont. Good luck :thumbs:

^^^ The highlighted part above is not correct.

The rule is that you and your fiancé must have met face to face within the two-year period previous to the date when the petition was filed. You have already done so. You were together in December 2011, so you have fulfilled the requirement. The clock does not start ticking again. There is no requirement that you meet face to face again.

You are misreading what I wrote. The fact that they have already filed the petition means they are good to go. If they had not filed the petition they would have to file it prior to Dec 2013 or not meet the two year requirement. I never said it runs out.

What you wrote was unclear. You did not say whether the requirement to "have met in person within two years of filing the K-1 petition" was previous to filing the K-1 petition or after the filing of the K-1 petition. Therefore, when you said "you are good until Dec 2013" and "there should be no problem" it left an open question of whether they needed to meet in person before December 2013.

Your fiancee will need to have a good job in order to sponsor you to come to the USA. US Emabasy in Philippines does not accept co-sponsors for K1 visas but will accept co-sponsor for I-130 visa if you and your fiancee get married. and then apply for IR1/CR1 visa.

Since there's a NOA-1 date of 2012-10-19 -

he would have had to see you DURING the 2 years prior, anytime back to 2010-10-18 .

Seems yer good, already. One less thing to worry about.

The PETITION will no tbe denied. A PETITION is not a visa. You will need to have the interview and apply for the visa in Manilla and they will decide if you have a legitimate relationship. That is wehere "evidence of relationship" comes in and visits are part of that. Someone with more experience with Manilla could possibly give a better answer
