I am a ugandan I married a US citizen in 2006 and we filed a spouse petition, we provided everything and on reaching the embassy for interview in Nairobi they had to find out the legitimacy of our papers. To our surprise our government found out that the church which married us was operating illegally in Uganda and they didn't have it in the Uganda's registry I was therefore denied a visa on that ground.

I went to the Uganda's registry to find out myself if I am regarded married or if am free to married some day and I was truthfully told that your single never married in our records and i was given a document certifying that. I told my fiancee about my findings and she told me that she cant afford coming back or starting afresh and she had moved on with another Boyfriend that I should move on too.

There came a nice cute, caring lady whom I proposed to and welcome my "WORD" in December 2009. she decided to visit me and we had a nice holiday in Nairobi and we enjoyed life and when she went back to States she filed a K1 petition for me and my 2 children one is 8 years and the last 5 years and she also has 2 children 6 and 10 respectively. We decided to have them together and bring them up in church and she is really a real mother.

Our petition was approved and sent to the consulate for processing and we have our wedding plans already and we chose 1st December as our wedding day before God.

My worry is whether I can get my visa approved since some one has ever filed a petition/relationship for which it didn't work out.

Does it help having my fiancee accompanying us (with my children) to the interview but if possible I wouldn't want to disturb her because her knee was just replaced recently in May.

I will be grateful for your advise and i will take it seriously.

I seriously forgot which form it was that asked you if you've applied for visa previously. Anyways, just tell the CO during the interview the truth and that you had previous petition but that didn't work out. Yes, the presence of your fiancee will be ideal but not a guarantee that you'll be approved.
