Who can explain to me this please:

The petitioner and foreign fiancee must have met in person within two years prior to filing the fiancee visa petition with the U.S. Citizenship and Immigration Services (the USCIS and formerly the "INS" - Immigration and Naturalization Service ). There is a hardship waiver available for this requirement, but it is extremely difficult to obtain. The fact that the petitioner is too busy with his work, children, sick parent, etc. will not be adequate to obtain the waiver. To qualify for a waiver, most often there is a medical condition that prevents the US citizen from international travel.

My fiance and I met last Sept. 2011. We first met April this year and we'll meet again next month Can he already file fiance visa? How long usually does it take to be approved?

The 2 year rule is about when the petition is filed. Based on what you say, the petition can be filed now.

it mean you guys need to meet within the 2years time frame prior to filing petition...if more than 2years you haven't SEEN you're fiance they will deny your K1 application...in your case seems that you guys met the requirement goodluck :thumbs:

The longer it takes to happen the more you'll appreciate it when it does!

yes, you've met the 1st requirements. 2nd will be, you both are free to marry (meaning any previous marriage should be terminated or finalized prior to filing)

As long as you have met in person within the last 2 years, you can file. It can take up to 9 months or longer to be get the visa in hand. It took us about 7 months, but depending what service center the case goes to, it can take longer than that. Some people are still waiting for their for case to be initially reviewed after 7 months at the Vermont service center. So there is no set timeframe. It also depending if they request anymore documents once your case has been reviewed, that can delay the process.
