Darn... Rejected Due To Signature..

My parents just got mail stating that MY application (as the step-child, who unfortunately turns 21 in SIX stupid days!), signed in the wrong part, he accidentally signed in F. rather than E. as the "other than petitioner" instead of "petitioner" ... It'll take a week to get there, then has to be accepted again... This is so annoying. I'm not going to make it to be age locked at 20... I don't know what to do..

Just raced into town to send it back again.. Unfortunately it's Friday 5pm here so the best we can do for posting is have it drive down 6 hours tonight to Brisbane, then be sent from Brisbane to LA then to Chicago. They said it should be "3-4 working days" so, Wednesday? Hopefully? It has the green rejection letter on top which it says to do and hopefully it'll get some kind of special priority, with the cover letter under it mentioning again that ageing out is imminent.. Now we just hope and wait :(

In our rush we also forgot to reattach another e-notification form so now we won't know until we receive a snail-mail letter, which by the way Mum also still hasn't got, although on the 11th September she got her e-notification of NOA1. This really sucks, just so annoyed it was a simple error like that and took a month to get it back to us to mention it... Sigh.

Oh no! Hoping for the best for you.

Keep us updated.

Tracking the package, it should be at LAX in a few hours. Going by the dates/times from the last packages tracking that we sent there, it took 3 days from LAX to get to Chicago and be received. So, it'll end up getting there ON the 27th (my 21st..). Thursday here, but hopefully still Wednesday there? Not sure what the green paper on top of the package will give us priority wise. It says to put it on top etc for something, I dunno, priority? Anyone had any experience with the priority on it..? Just really sucks that this happened, and right before my birthday too. Honestly devastated.. And we won't even know if it will be accepted as being under 21, or over 21? Like, we'll still get the approval of the I-130 in about a months time, but how will we know if they've taken it as under 21 or over 21??

Another question - really want answers/advice here :(

Is the NOA1 the same as the date petition is filed? Just looking at the CSPA age calculator, "Date Immigrant Petition Filed" - is that the day it gets to USCIS, or is it the date of the NOA1?

When the petition package has been screened it will be entered into the USCIS computer system, the check will be electronically cashed, and the NOA1 will be generated automatically. These usually all happen on the same day. That day becomes the priority date, which is the "date the petition was filed". That is often NOT the date that the petition arrives at USCIS. It's frequently a week or more later. They receive a stack of new petitions every day, and it takes them some time to process them into the system.

So, basically I have no chance now really at being placed as immediate relative under 21.. My mum said there was some kind of date on the rejection notice - but we were in such a rush to get it re-sent we should have made a copy of the notice or something. I don't know if she was thinking maybe it will revert back to the original date it was filed? Or with the green rejection form on top like they asked that maybe it would take less time than usual to get filed/NOA1? Just so shattered by it all..

Instead of mailing it in, have your parents rush to the nearest USCIS office to file in person. Hopefully, they can get it stamped with a PD before your birthday.

Can't, we all currently live in Australia. :( My parents want to move back there next year and the plan was to take me too.. Mum was ready to put me on a plane to the US though on Friday to take it in there myself rather than mail it! Haha.

Well, it's my 21st birthday here in Australia right now.. And I wish it wasn't.

The tracking on the mail has it "in transit" still to Chicago. It's stupid, you pay extra $$ for the fastest shipping possible, and it still screws you over.

Just shattered. Knowing my luck, it will get there ON my 21st birthday US time tomorrow.. And I'll be 21. Greaaat.

Well, it got there ON my 21st. I was right being unlucky.

My mums application was filed on the date USCIS received it, so if it was the same speed as for mine, it would have gotten a filing date OF my 21st birthday.

My parents rang USCIS twice before it arrived there, one person said "yeah it'll be fine", the other said it will depend on the person in charge of putting a filing date on it, if they're having a good day or in a good mood or not..

We emailed too, haven't gotten a reply yet.

I've got to be the only person who's had their application get there ON their 21st birthday. Quite disappointing. If only it was my mums application that had the signature in the wrong box... aahhh...

Well, we got our NOA1 today (much sooner than expected)... They gave me a priority date of 27th September. As an adult child. That's really frustrating. Parents aren't happy, obviously. Nor am I. Mum wants to appeal... They couldn't be nice and give us the one day backdated? Ugh.

Thanks.

Yeah, well that's what we expected them to do in the first place, we rang up twice and emailed them and they said "yep no worries it's fine" etc, and the other said "it's up to the discretion of the officer". But overall they said it should be fine. But nope. What a horrible birthday haha.

I'm not sure on the appeal process, apparently it takes about 5 months to get notification of appeal decision??
