Hey,

A family member of mine recently began trying to get a girl to the United States to marry. She is claiming she needs to own land and have a credit card before she is allowed to apply for the visa. I have limited working knowledge of H1-B's but this sounds like a scame to get money out of my family. Can someone fill me in if this does sound extremly fishy and where I can go to wake him up that she is lying to him.

Not sure what country she is from. But I know that is true in Poland. The consulate looks for "ties" to the home country on a H1 visa. She needs to show him that she has enough stuff in her home country that she will return to it. Examples are land, home, condo, bank accounts, work contract, letter from work, etc. If you are trying for her to come here for good then the H1-B is not the way to go :)

Either that, or she is talking about a tourist visa. In this case, owning a property would be a big advantage (but not a requirement).

O I'm sorry I was unclear...It isn't going to be on an H1-B. She is going to be brought over on a traveler visa and then they are going to apply for a marriage visa. See he hasn't met her yet..They met online so he is trying to get her over here to meet her and get married. But before she can come over she says she needs land, a credit card etc. I think she is from malaysia...I'm not sure though I'll ask him. But does this ereally sound legit for a normal travel visa/marriage visa?

Won't be approved for a K1 if they have not met in person within the last 2 years...

I would be very suspicious of this, sorry.

O I'm sorry I was unclear...It isn't going to be on an H1-B. She is going to be brought over on a traveler visa and then they are going to apply for a marriage visa.

Why won't they go for a normal K-1 route ? Safer and no ties to home country are needed...

Perfect just what I needed to know. He isn't the smartest cat. So i'll tell him to go with a K-1. I honestly think he is getting scammed by her. Just seems way to shady for me. Ok I'll read about the K-1 thank you very much!

Have your friend go over there for a visit.

Simple and easy, as compared to her coming over here. No land or credit card required!

Send your family member over here to read the guides at the top of the page. There is no land owning requirement for any marriage based visas. To get a tourist visa, she would need to show ties to her home country, and owning land is a good tie.

Suggest that he visit Malaysia. It's a beautiful country.

That sounds more like requirement to be issued a tourist visa. To be issued a tourist visa you need to show you have ties to the home country to show you intend to return.

He should go to her country to meet her.

What if she is not exactly who she represented herself to be on the internet?

Also, it might be very difficult for this woman to get a tourist visa to the United States--especially if there is any indication that she is planning on staying in the U.S.

Excellent I think that is the route I will instruct him to take. If he visit's her there then that would take care of the requirment for the K-1 and he wouldn't need to buy her land, a bank account etc.

However, if he dosn't she needs to own land etc for a travel visa makes sense.

Thank you all for your information like I said I'm just a bit cautious.

From what I have read, this is not the way to do this. If he wants to bring her to the US as a Fiancee, he needs to go through the K-1 process. If he wants to bring her here as a wife, he needs to marry her then bring her here on a K-3. Bringing her here on a tourist visa (which probably has a low chance of success anyway), marrying her then filing for a K-3 is definitely frowned upon by the USCIS. He will probably end up either (1) married to a woman who is an illegal alien or (2) married to a woman living in Malaysia who has a very hard time getting a K-3 visa or (3) filing a K-1 after a failed tourist visa attempt and trying to explain that in the petition and at the interview (this is the most likely outcome and it will at least delay her arrival in the US).

I am no expert on this, it is only my understanding from what I have read. If he wants to marry her, he should choose either the K-1 or the K-3 route. The tourist visa is not an acceptable alternative or shortcut.

08/03/06 -- Met online, have chatted almost every day since then

09/29/06 -- Met in person at the Lima Airport. 10 wonderful days together.

10/31/06 -- I-129F mailed to TSC

11/09/06 -- CSC cashes the check

11/14/06 -- NOA-1 Received

11/16/06 -- We get 11 days together in Arequipa (Betty's home town). I meet her family for the first time.

12/28/06 -- We get 19 days together in Arequipa. I'll be back in February.

01/18/07 -- Touched! First sign of life.

01/19/07 -- 12:10 AM, NOA-2! APPROVED!!!!!!!!!!!!! On to the next step.

01/19/07 -- Touched again, around 11 AM. I guess we're on the way to the NVC!!

If she really came here on a tourist VISA with intention to marry, that would be immigration fraud and she probably knows that. It's likely a scam to get the money for the land.

He should go there for a visit, then do a K-1 or K-3, or nothing (probably the best choice in this case).
