Hi everyone, our case is finally done with NVC step and now its been forwarded to the Embassy in Tokyo.

We couldn't make it this far without everyone's help and generous advises, so thank u!

now, i will have my interview on October 9th, which is the day before our 2 year wedding anniversary, and the letter we got from NVC states "CR-1" as "preference category," which is understandable.

But then, i do want to know, if there's any chance for me to get IR-1 visa instead of CR-1.

If everything goes well at the interview, will my visa be issued on the same day, or will it take a couple of days to be issued and mailed out?

If the latter, the visa will be issued after our 2 year wedding mark, which means i will get IR-1 visa?

I should be happy that everything has been going on smoothly and with whatever I get, I should be thankful for it.

But CR-1 and IR-1 makes so much difference in terms of future process, so I would love to get IR-1, if it's possible.

I'm thinking about asking the consular officer directly at the interview, but just wanted to see, if there's anyone who got IR-1 even before your 2 year wedding anniversary, even though the letter stated you would get CR-1?

I hope everyone's visa-related process goes with no further delay so that you will get to see your loved ones and start new life together.

you keep the interview day, but get your plane ticket and come over after ur 2yrs aniversity day, then u will get IR1 status, but keep in mind your visa will expire after 6 months from the day it issues.

Ultimately, the green card received is supposed to be based on the date of entry at POE, not the date the visa is issued. However, immigration is more likely to get it wrong than right if you just leave it in their hands to figure out. Even in cases where people hit their 2-yr anniversary between the case arriving at the consulate and the visa interview they tend to walk out with a CR1 because the consular officers default to the visa class as it was when they received the case. Same at POE. So while going through POE, make sure to present the marriage certificate and indicate that a 10-yr green card should be issued. If you're staying not too far from the consulate, it may also be possible to go back the day after the interview and request that the CR1 in the passport be changed to IR1, although following up with the POE to make sure the correct GC is requested would still be necessary.

Filed I-130 via CSC in Feb 2008. Petition approved June 2008. Consular interview in Mexico, Oct 2008, visa denied, INA 212a6cii. We allege improper application of the law in this case.

2012, started over in Seoul: I-130 filed DCF on 7/2, I-130 approved 8/8, Medical at Yonsei Severance 11/20, IR1 appointment in November 2012.

Print this out, cut it small, and staple it to the inside of yer passport bio page:

It is now 2 years past the marriage date,

I qualify for IR-1 designation.

Please update your computer,

showing IR-1 designation in your system.

If you not know how to do this, please

take me into secondary inspection and

I'll get it sorted there.

So, get this sorted at the POE. The blurb above is for the Customs and Border Patrol Officer(s ) that will be talking with you at the POE. You can get this 'fixed' at the POE, but usually after a long international flight, yer not going to remember to do this.

Printing this out, stapling it to your bio passport page, helps YOU remember to get it done,

and helps the CBP officer to get it done, as well.

I don't know if it will work or not, but you could also ask your interviewing officer if he/she could approve the visa the day after your interview instead of on the day (and this might happen anyway), specifically pointing out to him/her that 'tomorrow' is your 2 year anniversary and ask if they can issue an IR-1 instead of a CR-1. It may or may not work, but it is worth a try.
