K1 or I-485

Hello,

I am a U.S. citizen and my boyfriend is currently in the U.S. with a work permit. We don't know what to do, if I should file for a K1-fiance visa or him file for I-485-application to register permanent resident or adjust status. Which is the best route? any one gone through this? If so how was your experience.

What kind of visa did he arrive on? The replies you'll be getting depend on your answer.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

From filing I-129F petition until greencard in hand: 655 days

(her reply is usually spot on so it would be pointless for me to repeat what she posted)

Which route is suited for you completely depends on your situation.

For the K1, your fiancee will have to go back to home country, gather documents, do medical and go to interview at embassy(all of this in home country). I'd recommend this path if you wish to have a little more time before comitting to marrying, or if your boyfriend(fiance) would like to stay in home country before going through this process. Otherwise please read the link I provided, and take note if anything has changed since that topic(forms, requirements etc).
