Me And My Wife Got married My Wife(IR2 greencard Holder) We Sent in our I-130 I-485 I-765 and i got my EAD card In the mail within 4 Months. On the NOA 1 For My I-130 it Its Says spouse of a USC and We Have The AOS interview this Month Sept 2- 2012 ... Anyway the problem is we went to a lawyer and he told us we will most certainly be denied because we did not submit proof of USC but when we wrote up the I-130 Form We Put LPR and The Green Card Category IR2 So we did not do anything wrong . Question #1 - Do you think the lawyer is Right ? #2 - Can My Wife Get A US passport even tho she is over 18 now . she came here before she was 18 back in 2009. Please Help

I'm confused. Your wife is a green card holder and you are ... the immigrant? A USC? Who is applying to adjust status? When did your wife acquire a green card? One can't just get a US passport without first naturalizing and the spouse of an LPR isn't eligible to adjust status.

So she has only had her green card for 3 years. Then she is not eligible to be a citizen yet.

You are also not eligible to adjust based on your marriage to her. Only spouses of citizens can adjust immediately. LPRs must file the I-130 for their spouses. The immigrant spouse has to be in status the entire time (so usually in their own country but sometimes on a tourist or work visa, etc.) until a visa number is available - about 2.5 years. Your lawyer is right, you will absolutely be denied. There is no way around that. Your EAD will also be revoked at that time. I'd try to withdraw the I-485 at this time if I were you. What is your status?

I dont think we can withdraw it because we have an interview date already. from my understanding she Was Granted USC base on the fact wHen she Came Here She was a Minor And Her Mom Was married to a USC . 3 Years Before they Even Got to america And she was living with them for a year in The US

You said she has a greencard but you also said she was "granted" USC. You wife should know whether or not she's a USC.

Her mom marrying a US citizen doesn't make her a USC. If her mom became a USC before she turned 18, then she automatically becomes a USC as well. In that case, all she needs to do is get her passport as proof. Question is, did her mom become a citizen before she turned 18?

You cannot be a green card holder and a USC at the same time.

If she qualified for some type of relief that solidified her citizen status, was naturalized based on a parent, or has US citizenship by birth somehow, she should apply for and receive a Certificate of Citizenship (or Certificate of Naturalization, depending on her circumstances) before you even try to adjust status. Based on what you said, your application will likely be denied as you have no basis to adjust status--or are currently unable to prove it.

Agreed. There is a lot of confusion in this post. OP, you need to figure out exactly what status your wife has. If she is an LPR and not a USC then you weren't eligible to file I-485.

No. At 21 she is too old for an immediate visa. She would have to maintain her status until a visa is available. About 8 years or more.
