hey guys.....i read a ton of threads about q25, but I couldn´t find any pertaining to my question (they were all about whether it was necessary the 3 years, what if i didn´t file, etc).

My question is..... I have 3 years of tax transcripts which I will include. Which box do I check?

the first box says:

I have filed taxes for the 3 msot recent years, but have attached ONLY the most recent year´s returns.

The second box says:

I have attached returns for the 2nd and 3rd most recent years.

The first box says that I only have 1 year of return, but the 2nd box doesnt say "I have filed taxes." Am I reading too into this? Do I check box #2, or both?

Check both boxes, as you are providing 3 years of transcripts...

Check second box:

My interpretation is that - submitting the most recent year is a must. Therefore, checking the second box means that 'I have attached returns for the most recent year and is also attaching years 2 and 3.

Anyone agree?

Petitioner LPR upgraded to USC June 22, 2012
August 22, 2012: case complete
October 18, 2012: Interview (APPROVED)
October 26, 2012: Picked up visa from DHL (delay caused by Sandy)
December 15, 2012: POE Atlanta....................became USC July 2016!!!!

Mothers' Journey (My sister is the petitioner)

September 10, 2013: Sent I-130 (UPS next day service)

September 12, 2013: Received text to confirm delivery

September 16, 2013: Received NOA 1

March 22, 2014: Received NOA 2

April 8, 2014: File Received by NVC

May 26, 2015: Interview (approved)..........now LPR (delays caused by 2 RFE)

Check second box:

I definately agree with you, but I don't think it will be a problem if both boxes were checked. But definately check the 2nd box.

The requirement has changed. Previously, it's required to submit the past three years of income tax. Now, it's required just the most recent year of income tax, so it's OK to check the first box and submit your most recent income tax, but you can also check the second box and submit the previous years of income tax if you like. Another change to I-864 is that, unless requested, it is not required to submit a letter of employment.
