Hi Everyone

I came here on K1 visa. We decided to delay our religious marriage until i get settle and we just did our civil marriage for AOS. Few days after submitting AOS application in FL, i then moved to Louisiana to live with my cousins. I just want to ask from where i should make my driver license? Somebody suggested me not to make it from Louisiana as USCIS can find out if i am living in different state not with my fiancee.

Technically, you are suppose to have a driver's license in the state that you live in. Since you state you are living with your cousins is in Louisiana, then you are suppose to get one there. But that is all up to you.

The fact that you got married then moved away to live with cousins may or may not come up. It is not normal for couples who are just married to live apart. That may raise issues if found out.

In your last sentence, you obviously understand that there may be some concerns. Why would you risk it??

I agree. It will be harder to prove a bona fide marriage when living separately in different states. You also called your spouse your fiancee. Be careful with that type of thing around USCIS. You will need solid proof of your marriage and a good explanation as to why you do not live together.

Also, are you saying you plan on trying to hide the fact that you do not live together from USCIS?

If living in different state would be such problem, then as Que Saudade said i shouldn't take any risk.

Also, are you saying you plan on trying to hide the fact that you do not live together from USCIS?

Your case was transferred, so you may be approved without interview and not need to tell them anything. If you do get called for an interview it will come up because you must bring proof of residing together and co-mingling of your lives. They want to see joint bank accounts, shared insurance plans, shared utilities, both names on rental agreement/mortgage, copies of IDs showing same address, etc.

Who knows exactly what they know... One can only speculate the technological tools they use without telling the general public.

Maybe they put your name into a government database and looks for your name. Being that a Department of Motor Bureau is a state government run agency and driver information is shared between law enforcement agencies, then maybe your name comes up with your drivers license in one state, and your husband is in another. This would definitely create a scenario for USCIS wanting to ask why.

Right now, it just looks "suspicious" with you getting a quick civil marriage just to file AOS, then once you did that, you moved away from your husband.

With most couples once they get married having waited all that time to get the K1 visa, the last thing they want is to be apart.

This would make anyone very suspicious that you are using this marriage to get a green card, not have a life with your spouse.

I want to correct my statement.

I was wrong. You do need to tell them. It is up to you to decide if you want to follow the law or not.

According to USCIS, any non-US citizen must report a change of address within 10 days of moving.

Dont move unless you want to risk getting rejected. mm If its just a temporary move its okay.But you dont want to live away for more than a month or so. Definitely don't get a license in the other state. Why r u moving anyways?? can't it wait till after you get a GC? Believe me, they know more than u could imagine. If they suspect they will investigate and then they will find out that u r living in a different place and they can reject based on that.

By law you must carry a DL from the state where you reside. By law you must notify the USCIS if you change address. Unless your husband is joining you soon afterwards, it will all look very suspicious to the USCIS.
