I have a few questions on form I-485 Part 3 - B ask the following question "Applying with you" about my husband should I answer Yes?

My husband is in the military do we need to add anything special to our application?

For the affidavit of Support it is enough if he send the form I-864 and the last year tax return or he needs to send the last 3 years tax return? Also if he makes more than $19,000 a year we do not have to include a joint sponsor right?

On I-864 Part 5 - Sponsor's Household Size letter C should I include 1 since we are married or 0? On the example forms was 0 but I wasn't sure.

Do I have to send certified copy of my birth certificate translation to english or can I just make simple copies ? For all the other documents other than divorce decree and marriage certificate it is enough if I make simple copies or they need all need to be certified?

If he makes more then that and does not have any kids, does not claim anyone else on his tax return then it will be enough and you don't need a co-sponsor. Just last years tax return is enough.

Translate your birth certificate if it's not in English( mine is in 3 languages). A certified divorce decree from US court costs 5 dollars better to send a certified one,( if you are talking about yours then it needs to be a legalized translation) I sent one legalized copy of my marriage license( they gave us 5 when we got married they cost 5 dollars each at the courthouse) and two copies, one for EAD one for Ap.

Sponsors household size now it's 2( you and him).

On your first question you should put no, your husband it's not applying with you, you apply for yourself.

My question about the certified copies is because on I-130 intructions says

"Copies: Unless specifically required that an original document be filed with an application or petition, a legible photocopy may be submitted."

And when I read the documents I have to attach only say COPY of marriage decree, COPY of marriage certificate so I was not sure if a simple copy is enough or needs to be certified?? Anyone knows?

Also my birth certificate translation needs to be certified or I can make a simple copy as well??

Also I have another question my husband lives in California and I live in Minnesota do we have to submit to the lockbox in Phoenix AZ since he is the petitioner or can I submit to the lockbox in Chicago IL??

I just read here that I must submit all to Chicago Lockbox so now the only question I have is regarding the marriage certificate, marriage degree and birth certificate translation if we need to send certified copies or it can be simple copies. For what I read on the instructions I can send simple copies.

You send normal photocopies in the packet and then at the interview take original certified copies. They can ask to see those at the interview and you will be RFE'd for them if you cannot produce them when they ask. Often they will never ask to see them and you will have no issue.

You do not have to have a professional translator do the translations. As long as the person is fluent in both languages (it can be you too), you are fine. You just need to attach a statement certifying that you (or the person translating) is fluent in both Portuguese and English. This is the format that I used without any problems. I did the translation for my husband's documents.

Certification by Translator

I, (name of translator), certify that I am fluent (conversant) in the English and Portuguese languages, and that the above/attached document is an accurate translation of the document attached entitled (name of document in Portuguese).

You also do not need any kind of stamp or seal saying that it is a certified translation. Just send this document with each translation that you do. Good luck!
