Hi guys.

I am a woman, an American citizen, 46 years of age. I met and fell in love with a young man. He is 24 years old on a student visa. We've been together for two years and we are talking about marriage. When we decided to look into immigration procedures so that immediately after getting married we could file for his Adjustment of Status, one of my friends commented that our petition will never be approved because of our age difference. I really need some advice on this because it's gonna have a major effect on our lives.

You may get some more questions during an interview, but to be outright denied for age, not happening!!

Hello and welcome to VJ. The age gap is a cause for some concern and you were right in coming here to ask so you'll know the best way to prepare. At least you're getting started on the right foot! Proving your relationship is genuine is the main concern I believe. Adjusting status from a student visa isn't my area of expertise, lol, but someone else will come along and guide you I am sure. I really wish you the best with everything!

I will explain the issue to you and it's NOT my intention to make you feel bad or hurt you. I will simply lay out the problem and it may or may NOT apply to you or your SO. This is their train of thought:

It isn't unheard of to be denied due to the age difference. Now, know this is not based out of outright blatant discrimination, but based on the fact that it isn't a cultural norm from men from that region to marry a older female outside of child bearing age. For example: I am 7 years older than my husband- he is 29 and I'm 36. I'm still within child bearing age. But your case is rather difficult given you're over 20 years older.

Why? It is very common for young men from the MENA and Africa region to 'befriend' an older lady for the GC benefit and, once the 'visa journey' is completed (no pun intended) they abandon their spouse. It's called immigration fraud and the idea is to pull a con/ scam marriage on the victim. The common traits of the female victims are: white, divorced with children, outside of child bearing age, limited financial resources (so you don't hire a lawyer to come after them, LOL).

Again, this may not be your case. All you must do is proof beyond any doubt that your relationship is genuine.

Age gap could be a problem but not if you have enough proofs. Read some posts on what type of proofs u can send and start on them early. For example, you need to open a joint bank account, apply for joint credit cards, list both names on leases, bills etc. Keep honeymoon boarding passes or vacation hotel confirmations with both names on it. I think if you have enough proofs and everything has both of ur names , they have no reason to deny. They can't say " we are denying because of your age gap" . usually they say " you need to submit additional documents to prove that you are married" SO, if you already have more than enough proofs they can't reject you :) I know your husband is a student so it might be hard for him to have too many assets but make sure ur name on is on his stuff too. my husbadn was a student and during interview the officer told us that it seems like his name is on my banks, houses, insurances but my name is not on his stuff. so they want to make sure he is not taking advantage of u. if u simple list him on everyting of urs, then they wil think he is going to do fraud with u. so to protect american citizen they can reject. So , you have to balance. If he has a car, ask him to list u on the title.

I would wait to apply after getting married. Like wait 1 year. You want to make sure you he is going to stick with u before applying for him. I am not suspecting or anything but it will also look good that u were married for 1 year and then the case was applied. Then the case will look real to the immigration officer. I can understand though him being a student, its difficult to wait because he will go out of status. maybe he can get a job and get his work to do H1 visa? I have seen some people get GC that way. its longer process but safer.

I totally agree with this. I've seen some cases about this, bunch of fraud and scam. Be careful and hope that guy you met is genuine. God Bless
