Hello all,

Some of you may remember some of my posts from a while ago, I filed my i751 with a divorce waiver as I was in the process of getting a divorce, unfortunately 6 months have passed and my wife has consistently given me issues about signing paperwork, we both agreed to a simplified divorce which Florida offers, but now she's intent on making my life as difficult as possible.

In the event that I receive an RFE for the divorce certificate and I am unable to provide it within the 87 days, what happens? Can anyone give me any advice or point me in the right direction? These last 6 months have been nothing but stress and i feel like I'm running out of options.

You will receive a denial. You will go to an immigration hearing. At this hearing you will tell the judge you're waiting on your divorce decree. He will order the process to be on hold until you get your decree. You mail your decree when you get it. ROC continues.

Is this something that happens often? Should I be worried?

Hi! Im in the same boat here (filing while divorce pending). I have a lawyer. And she told me exactly the same thing as Vanessa&Tony stated. She said that divorce is something that happens a lot nowadays. And USCIS and Immigration Judge understand that. You will not be removed and will keep the right to work. The Judge will just give an extension till you have divorce decree in hand. I don't think you should be worried. (F)

The Immigration Judge thing? Yeah it happens quite a bit and no I wouldn't really be worried. you have proof of relationship the only thing you're missing is the decree. By all mean don't take it lightly, dress appropriately at court and be respectful. Advise you are waiting on the decree and show proof of filing as well as your states waiting periods or whatever and it should be fine.
