Okay so I don't claim child support when I file taxes but its recorded as household income (i think?). my Questions:

1)Do I mention it on the i864 (I could definitely use the help)?

2)I do not see anywhere special for that kind of income, so do I notate in somewhere in particular?

3)I don't have a very good paper trail, or much of one at all for the sporadic payments I receive. How can/should I document it?

4)My grandfather, I care for him in my household and his retirement takes care of us, but he is not my "dependent" per say. Can I use him as a household combined income sponsor?

I was separated from my XH for a couple years in which we have taxes filed together, but I don't have copies of his W2's, transcripts, nor do I have any income represented on it. I have only this year's tax form, filed HoH only on my pittance.

5) Do I bother with trying to get these from him? Does it matter since my individual income is 0?

6) I am confused on the marriage thing to, if my co-sponsor will report only their individual income or her combined income with her husband. (I don't need her husband's extra)

7) Also when it asked me income from taxes from last 3 years... well it includes my Xh's so... do I write 0 or what number we filed with?

8)NAO2 July 26 with and NVC received date of Aug 5, but no NVC # yet. From what I can tell there is no rhyme or reason to how long this takes, right?

Use the I-864 and below employment there is a self employment section. Just enter "Court Ordered Child Support" in that space and then add the child support to your employment income when stating total household income on line 23. Document the Child support with a copy of the court order and some kind of documentation you are actually receiving it. A few bank statements would do but some people have statements from their State agency if the payments pass through a State agency.

If your income was always zero on the tax returns, that's OK. Order "Tax Return Transcripts" from the IRS. They are free and take a week or ten days to get. Is your income still zero today, not counting the child support?

Yes, I have essentially a 0 income :blush: minus child support, being a full time student. I wish to list my granddad as my combined household income as he covers the household expenses, and he likes my DH. :)

I see. If its' just you and your granddad, then you do want to list your child support on YOUR I-864 and then have him file an I-864a as your household member. I will caution you thought that particularly elderly sponsor's can be problematic because they may not be around to fulfill the sponsorship obligations which are terminated by death of the sponsor. You might want to add a letter explaining what your career will be and when, to help the Consular Officer make a favorable decision on the public charge concern.

You should also be aware that your circumstances are at least a partial fit for a common fraud scenario from N. Africa. If you are also significantly older and of a different religion than your husband, you've got some huge red flags to overcome.

If there is the possibility they will review a letter of my future employment possibility, then that will also look good. In 1 year I should be able to practice as a registered nurse. I will for sure include this then. Anything to make my future look less bleak!

I am trying to figure the best route for sponsorships. I have a few people willing to co-sponsor on my behalf, the option of the household combined income, or I have the last resort assets measures of my spouse. (thinking the latter is not good to avoid red flags)

You'll still need a qualified joint sponsor but information about your near future career will help. Crossing off those two red flags helps too. If you have a close friend or relative who is not elderly and well qualified, that would be a better choice.

Thanks for all these helpful comments. My case is a little different! I have a kid from my ex-boyfriend and I also have documents for "Court Ordered Child Support". But he has never paid any kind of support in last 5 years (since my child was 6 months). I recently reported DHHS that I haven't received any money all these years and they told me they are going to force him to pay the money... Since my income is $22000 and the only way to meet poverty guideline requirement (almost $23800) is reporting this child support, Can I consider it as my income without providing evidence of payment?

Is that your most recent income or it has been like that (below poverty limit) for the last 3 years?

I guess to make up the 2,000 gap, u can just take a second part time job to add to that.

It was almost the same for 2009 and 2010. But it was less than $22000 last year because I took the whole summer off! I am going to get a second job to meet the income requirement and we are planning to file next month.

Does it make any problem that I have been paid only once for my new job before filing?

No, it doesn't matter. You don't submit the affidavit of support until months after you file the I-130 petition.
