Hi Everyone,

Sadly my fiance's mother died last week. I wanted to know if this has happened to anyone while their case was waiting to be approved (I hope not) but if so...what did they do?

Should I call USCIS?

I know that her untimely death has nothing to do with his and my visa application but I wondered anyway...

The information we put down about her, name, dob, place of birth, etc. is all correct and the address we wrote is her last address.

I just wondered if I should call and tell them to make a note on our application.

However, I don't want them to ask for a death certificate and have that put our process off even longer (I'm already sick of waiting - it's been 5 weeks). I don't know if my fiance has one yet and then we would have to have it translated.

On the other hand, could I ask that my case be expedited because of this loss. My fiance needs me even more now...

As tempting as it might feel to try to expedite the petition, chances are it won't happen. I know you can comfort your fiancé and offer support from here, he's probably going to appreciate being with the rest of his family through this difficult time. Your time will come.. :)

I also don't see any reason why you would need to let them know now. I'd also be curious if they would expedite in this situation - CSC doesn't seem to very open to expedites and my guess is they would simply say you can go there to visit.

Sorry for whats going on with your fiance....but if you are already sick of waiting and it has been only 5 weeks, you are gonna need more strength cause believe me, you are not done waiting...

My fiance has lost both of us parents in the past 12 months and so this is just really hard for him. It affects me too. :(

Why don't you try to get it expedited? Who knows, you might have a valid case although again, I assume they would expect you to travel there.

General Expedite Procedures:

A detailed explanation of the situation should be provided in a one-page support letter prepared and signed by the petitioner or the applicant. An expedite request can be submitted by mail or fax. When mailing, mark the envelope with a red dot and send the request via bonded courier or other overnight delivery service to:

Cases will not be expedited if they are not clearly approvable. Requests to expedite petitions or applications that are incomplete will not be granted. All supporting documents not in English must include a certified translation. See Documents Not in English" section. Please see our USCIS Expedited Criteria guidance. There is no appeal of the denial of an expedite request.

USCIS Expedite Criteria

All expedite requests are reviewed on a case-by-case basis, and are granted at the discretion of the Service Center Director. The criteria are as follows:

Severe financial loss to company or individual.

Extreme emergent situation.

Humanitarian situation.

Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States.

Department of Defense or National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government.)

USCIS error.

Compelling interest of USCIS.

If a response to the expedite request is not received within 72 hours, the request is denied. The application or petition will then undergo normal processing.

Why would you need your case expidited for you to go visit your fiance if you are the USC ?? Can't you just hop on a plane and go there ??

very true. Ours was quick, and it took 6 months.

And no death certificate is needed.
