hello am new here and am here because i need an advice or suggestion .after reading your experiences i decided to join. I am in a relationship with a woman 20 yrs older than me. i have known her for 7 yrs.we we met online. we are in love and planing to be together. she is visiting in February 2013 can anyone tell me the best way to go about things? can the age difference make it difficult for us? is it ok to file for k1 visa here in ghana? can she help me do that whiles in Ghana? at the USA EMBASSY HERE in ghana? also she does not earn much..financially, can that stop the embassy from grantin k1 visa? what is the best way forward. thank you

I suspect the age difference will only raise an eyebrow (or 20) at the Embassy interview stage of things, and your case will surely be put under scrutiny as a result, so be prepared to show a LOT of evidence of your 7 year relationship together in order to purge the thought that this might be a scam-for-green-card marriage.

BUT... that's at the Embassy stage. The first step is the USCIS stage, and I don't believe they will give you much trouble with that there.

As for the rest of your questions:

- You don't file for K1 visa in another country, you file for it in the US. To clarify, YOU don't... your US citizen fiance does.

- Moreover, If your fiance and yourself have met within the past 2 years (and have sufficient proof to prove that you have met within the past 2 years) then she can file for it right now, without needing to wait for the february 2013 trip. (IMPORTANT: The meet must have taken place BEFORE the petition. You can't send the petition and then meet afterward).

- If you haven't met within the past 2 years, make sure to collect as much proof as you can during the february 2013 trip (as that will have to be the trip she uses to show that you are eligible for a K1 petition) and then she can file for the K1 when she returns to the US.

- She needs to earn a specific amount of money (I think 125% of poverty line) to be able to sponsor you on a K1 (or any) visa. If she doesn't earn that much, then she will need a co-sponsor.

I've done the best I can to parrot info I've read on these forums as well as on the guides of these forums. But again... I'm just a parrot, not an expert. You would do well to research some yourself, and read the K1 visa guides here to learn everything you need to know about the process.

You will most likely be scrutinized at least a little at the interview stage due to your age difference; have a good reason why this doesn't matter to either of you and lot's of proof of your relationship.

To file the K-1 you must have met within the last 2 years, if you haven't your petition will be denied. Your fiancee the USC files the petition, not you.

Your fiancee needs to make $18,913 in 2012 to be above the federal poverty guidelines at 125% for 2 people. If she has a family or you have dependents who will move with you then that number will be higher. The number will probably increase in 2013 as well. If your fiancee does not make that amount of money she will need a co-sponsor.

The first thing you should do is scroll to the top of this page and click on "Guides" and read about the K-1 process and requirements. The guides are very helpful.

Do you have any income that will continue once you are in the US, such as business income, rental property etc. Also are you able to work once in the US?(meaning are you physically able to work, do you have special training etc.)

The best thing to overcome the age difference is to strengthen the proof you have that this is a bonafide relationship! In my opinion, the BEST way to do this (if possible) is to spend a lot of time together face to face. How long will she be staying when she comes in 2013? I would suggest she stay as long as possible. OR after she sends in the petition, plan more trips to come see you while waiting til the interview stage.

You say that you have known each other for 7 years...do you have proof of chats, emails, phone calls, etc going back the 7 years? that will help as well.

As for her financial situation..if she does not meet the financial requirements, she could use a co-sponsor and that would be good enough to satisfy that requirement. Assets can also be used (for example if she owned her own house, etc).

As for filing the petition...Im here in Ghana living with my husband, we're going to file directly to the embassy here because they have a USCIS office in Accra. HOWEVER, I have to be an official resident here before I can do that and getting that permit is wat is holding up our process a little. IF she stayed long enough, she could go that route as well, if not, she can file as soon as she returns home.
