Hello I seriously need help. I married my husband from Ghana back in 2007. We seperated in 2008 with no contact for almost 4 years. We spoke and he wanted me to file papers even though we weren't together all because I am his wife. I realized after putting the paper work in that we aren't meant to be and he is just using me to start fresh and new here in the united states. Since then he still hasn't recieved his visa because they are now questioning his identity I want to with draw his papers. I barely speak to him and don't want my status as a US citizen dragged through something bad. How can i withdraw his paper work and what do i say on the letter

You need to tell us which stage of the process you are in. Has the petition been approved by the USCIS and forwarded to the NCV? Or is the petition processed by the NVC and sent to the embassy in Ghana? You can write official letters and send to USCIS, NVC, and the U.S embassy by registered mail that requires the reciever's signature, explaining you are pulling your affidavit of support and terminate the process because you're no more together. It's good that you have known his intentions ahead of time before you became a victim.

He has been up for his visa 3 x already they keep denying it cause of identity so I'm pulling out

Embassy as the first instance - consular chief and reference case number. USCIS for information.

In the meantime, time to think about getting divorced? Can do it from the US, even without his cooperation - publication in the newspaper?

Best bet is to go to your local office if you have one and submit a letter. GET A DIVORCE which can be easily done without him. Just tell them he resides overseas, they will require you to put a notice in the newspaper and there will be a waiting period..but it WILL get done in time. You don't even need a lawyer...just get the paperwork online or at the courthouse. I would start that process as soon as possible so you can cut ties with him.

Newspaper how is that ;possible if he isn't in the united states. do i put my newspaper or his he is in Ghana

It doesn't matter if he sees it in the paper. It just needs to be put in a pulic record in the U.S.

You can make an infopass to your local office. Take with you a statement as to what has happened in your relationship and why you wish to withdraw your petition. They will have a form specifically for withdrawing your I130 application. It is on sheet asking basic information and an area at the bottom asking why you wish to withdraw. If you arrive at your infopass with your statement, you can complete this form while at the office and attach your statement. They will look up your case so have your receipt number with you, and they will forward your withdrawal statement and form to the appropriate location and your process will come to an end. It is as simple as that.
