Intent to stay / immigrate?

Hey all!

My husband came up to visit me on a B1/B2 this year in February and originaly planned to stay till March, but ended up changing his mind after her got here and changed his return ticket to July. We ended up getting married in June, and we decided to file for AOS this month. In regards to proving there was no intent to immigrate and stay, was sending in his original travel documents & itinerary along with his current ticket home a good way to show his intentions was to visit?

Our journey so far...

07/2005 - We met while I was visiting family on the island, became friends, kept in contact over the years.

08/2011 - He came to visit me, and we started a long distance relationship when he left. Skype is our best friend.

12/2011 - Trip to visit him for the holidays and meet his family; got engaged New Years Eve!

02/2012 - He comes up here for a 3 week visit, then decides to stay till my lil sister's graduation.

06/2012 - Decided to get married! :D

06/25/2012 - Start putting together AOS paperwork.

07/13/2012 - Medical Exam & vaccines.

07/17/2012 - AOS packet sent. (I-130, I-485, I-864, I-131, G-325A, I-765, G-1145)

07/18/2012 - Package delivered and signed for.

07/23/2012 - Checks cashed.

07/28/2012 - First NOA's received in mail.

08/01/2012 - Recieved biometrics appointment notice in mail for 08/20.

08/20/2012 - Biometrics appointment in Nashville successful.

09/07/2012 - Interview appointment received in mail for 10/09.

09/21/2012 - Recieved EAD card in the mail. :D

Not really. What you stated certainly sounds plausible. The interviewing officer will determine that in the interview.

The return ticket helps but isn't "proof." Just tell the story honestly and it ought to be evident.

Thanks! :] I'm not worried, I plan on telling it as it is. I was just seeing what other peoples opinions were & to see if sending it was helpful or unnecessary.

We have a similar situation. I didn't send in the plane ticket with our application, but I'll bring it to the interview just in case it comes up.

AOS

5/16/2012 - Package delivered to Chicago Lockbox at 1:33pm

5/21/2012 - Email/text notifications received at 4:50 p.m.

5/26/2012 - NOA hard copies received for I-130, I-485 and I-765

6/19/2012 - Biometrics completed.

7/02/2012 - Text/email/hard copy notification of interview.

7/30/2012 - EAD card production ordered.

8/02/2012 - Interview @ 2:00

8/02/2012 - Email notification of GC production at 5:30pm

8/07/2012 - Second GC production email

8/07/2012 - EAD received.

8/08/2012 - GC mailed.

8/09/2012 - Welcome letter and I-130 approval letter received.

8/10/2012 - Green card received. :)

I don't see the point in sending it at all. No one is ever flat-out asked about intention, and to try to 'prove' it without being asked may be volunteering too much info.

Btw, keep in mind people here like to make a big fuss about intention, but the fact is intention alone is NOT enough for them to deny a case that would otherwise be approve-able, so it's something of a mountain out of a molehill if you ask me.

2009 - COS to H-1
2011 - Married USC

Conditional GC Process:
04/2012 - Concurrent I-130 petition / I-485 AOS / I-765 EAD / I-131 AP sent
35 days to biometrics, 73 days to EAD/AP combo card, 85 days to interview, 96 days to Conditional Green Card

04/2014 - Eligible for ROC

06/2014 - I-751 package filing joint with spouse sent

5 days to extension,37 days to biometrics, 172 days to CSC transfer, 247 days to Green Card

04/2015 - Eligible for Citizenship

09/2015 - N-400 package filing on basis of USC spouse sent

29 days to biometrics, 105 days to interview, 147 days to oath and US citizenship

~ 9 years and 6 months from first entry to US citizenship
