Hi everyone, I'm really hoping someone can help me. My Australian fiance and I filed our K-1 petition back in February and it got approved on July 6. Just the other day I got an email from the embassy/consulate in Sydney with the packet containing information on the next bits of the process. My fiance is very on the ball and has already scheduled his police check and medical and filled out all his paperwork. However, I am still stuck on the affidavit of support form and I am really hoping I can get this figured out ASAP so I can send him my forms.

I read all through the "tips on the affidavit of support" page that I found in the Guides section of this site. However, I am still really confused about how to fill it out if you're using a co-sponsor and I couldn't find any examples. My situation is that I moved back to the US from Australia a few months ago (I lived there for three years while doing my master's degree). I've been searching for a job like crazy ever since I got back (well, even before I came back actually) but have had no luck so far. Therefore I have nothing to put down in the employer/income sections of the I-134 form. I've asked my dad if he would be willing to be a co-sponsor for me and he agreed, but he got really frustrated when he looked at the I-134 form and the instructions for it because it just really doesn't explain anything as well as it should. Maybe I'm just being dense, but I'm really paranoid about filling something out wrong.

I've asked my fiance to see if he can figure it out but he says he just keeps finding a bunch of conflicting information online, which was pretty much my experience as well. My dad just wants me to tell him what to do. I'm just feeling overwhelmed. I already feel terrible enough that I'm unemployed...I really had no clue how bad the economy was here until I actually got back, but being unemployed and applying unsuccessfully for SO many jobs and thus being unable to support my fiance MYSELF has just really been taking its toll on me. I've FINALLY just had a couple of good phone interviews in the past week (and one of them has led to an in-person interview this Wednesday, which I am flying out for), so my luck MAY be finally turning around. I was sort of wondering if I should wait a week or two and see if I get a job offer from either of the places I interviewed with, because I know they will at least let me know soon, but I also don't want to delay the visa/paperwork process any more than I absolutely have to. Also, even if I did get a new job in the next week or two, I don't know if that would allow me to file the affidavit of support myself or not.

Anyway...if anyone can help me out here, it would be SO much appreciated. Thank you!!

Is there a specific part of the form that is causing confusion? Or is it related to not knowing how your father should fill it the form?

Follow the example form here on VJ. It's really helpful. I have followed all the example forms here and seems that they are correct because no one has given me problems over them. My guess is that if you aren't working then you wouldn't fill that part in (with N/A instead of listening job title, employer, etc.)

The instructions for the I-134 are vague. The consulates go by the guidelines for the I-864 anyway, so you can read those instructions and they may help some: http://www.uscis.gov/files/form/i-864instr.pdf

Your father must make 125% of the poverty level or higher for his own household size plus your fiance. How to count household size is in the I-864 instructions. Here are the poverty guidelines: http://www.uscis.gov/files/form/i-864p.pdf

You will simply fill out your own I-134 and put $0 income and that you are unemployed. Include a statement that you were a student getting your Master's and you were not legally required to file taxes in 2011. Your father will fill out his own separate I-134 and provide his 2011 tax transcript, letter from employer and most recent pay stub(s) to prove current income. He fills in his own info at the beginning of the form, then your fiance's info in #3 and his relationship to your fiance is future father-in-law. #7 is where he lists his employment info and salary. If he makes the 125% requirement solely with his income, then no need to list any assets(like savings, stocks, mortgage) and he can leave those blank. #8 he lists any spouse, dependent children, or anyone else he claims on his taxes. #9 and 10 for him would be 'None'. Follow the example form for #11.

Is there a sample of the i-864 for k1 visa? Thanks in advance.

You won't use the I-864 for a K-1. You will use the I-134 form. The consulates follow the guidelines for the I-864 when deciding if they believe the beneficiary will become a public charge or not.

So, use the I-134 example because that is the form you will use. You can read through the I-864 instructions to better understand the guidelines they are looking for. You will use the I-864 after you are married and the foreign spouse files for AOS.

But we need a co-sponsor (his parents) that's why we are also filling out the i-864. Isn't that needed in the USEM interview?

Btw, his dad files a combined income with his mom together. But since it is his dad who has a higher income, mom doesn't need to file the i-864 anymore, right? No need for the i-864a? Sorry for all the questions. It's just better understood for me when explained.

Oh, so you will be going through Manila then? Manila does not always accept a co-sponsor, so be aware of that. I believe it is best to use a family member and I believe they do ask for the I-864 for a co-sponsor there. I think Singapore will only require an I-134 from the co-sponsor, same as from the petitioner. You can always email the consulate directly and ask them.
