Filing AOS - Need help with FORM I-130

Hello !

My wife and me are working on putting together this AOS package together. :wacko:

I have few questions on I-130, please help: (caution :D : They might sound dumb to you but i am just making sure)

a. It says Family name in CAPS. Do we need to put other names, address etc also in CAPS?

b. What is the better way: Print the blank forms, then write, and sign OR Type in the forms, save and print and then sign it?

c. Under other names used, should be put nickname? I am thinking to put NONE to avoid any confusion.

d. for 14. - arrived as: (i came on HIB) what should i put; WORKER/HIGHLY SKILLED WORKER/H1B

- Also, the I-94 i entered with was expired long time back, Never went out of USA after that, i got new I-94 after H1B extension which is expiring in Dec 2012. Which one i should use?

e. For C.17 - List husband/wife and all children of your relative: Here goes Petitioner name or Beneficiary name along with Beneficiary's children?

f. For 20. What to put here?

g. For D.1 Separate petition... My wife will be filing for my Daughter as well. So, she need to put her name here here? And relationship - Step Daughter?

I think for today this is sufficient.

If you guys pass this test, i'll give you more :devil::D .

a. Does not matter.

b. Though typing is neater, I personally think hand writing is safer (as long as you are neat). i have seen people freak out and realize they made typos with dates or names spelled wrong on their petition, and this does not happen with handwriting. However, whatever you like best is fine.

c. Yes nickname.

d. H1B and new I-94.

e. This is the USC's form. Put the USC, though it seems odd. (The USC is the wife of the relative being petitioned.)

f. You'll have to say what question 20 is. No one memorizes the question numbers :)

g. Yes I think so, but I am not sure what 20D is without checking.

To be successful in this process, you need to be able to read accurately and interpret LITERALLY. If it asks for other names used, then put other names used. If it says name in CAPS, then the name must be in caps, and nothing else. It's just THAT simple.

Agree with Harpa for all the answers, and especially the part where you LITERALLY have to read carefully, and interpret LITERALLY!

Make sure to go back and forth at separate times to check your answers and the requirements, as it can get very overwhelming and may lose a minute detail here or there.

you LITERALLY have to read carefully, and interpret LITERALLY!

Make sure to go back and forth at separate times to check your answers and the requirements, as it can get very overwhelming and may lose a minute detail here or there.

Here are the questions:

f. For 20 - If your relative's native alphabet is other than Roman letters, write his name & address in native alphabets

Does that mean i need to write in my country's language (India, hindi)?

g. For D.1 if Separate petition are also being submitted for other relatives give names of each & relationship.

(... My wife will be filing for my Daughter as well. So, she need to put her name here? And relationship - Step Daughter?)

Regarding roman/latin alphabet/letter;

My name(maiden) in native language is L****ø. Since US alphabet doesn't have that "Ø" letter, they're asking to put the name in native language. In English, my name is L****oe. In native, it's L****ø. :)

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

In Q.13: If you're US citizen, Complete the following:

a- Birth in the USA (Definitely No)

b- Naturalization. Give certificate number & date, & place of issuance (She lost her Naturalization certificate)

c- Parents. Have you obtained a certificate of Citizenship in yr own name:

> Yes (Give certificate number & date, & place of issuance)

> No

My wife got GC thro' her father. So, what she should put here?

A bit out of my range of knowledge with naturalization. Does she have a US passport? Some advise to put unknown in certificate number, and submit a copy of the US passport instead. Wait up and see what other replies rolls in.

I think she can call USCIS to find out those information?

There must be a way to replace her Naturalization certificate. You better figure it out, because I think you need to bring it to the interview.
