Hi Everyone! I have a quick question. I helped my friend filing for her AOS

And it got denied because of the payment. Well, what happened is that she filed the work permit first and paid 300 something. Then After a month she filed for AOS and paid 600 something because she already paid for the work Permit. Now why it got

Denied? Does she need to pay the whole amount even if she paid the work permit? Please help what to do?

Are you sure the notice says its Denied or maybe rejection notice due to incorrect fee???

From what I understand, if you file AOS, it costs $1070. You can file for the work permit at the same time as the AOS for no cost. If you file for the work permit separately, you will have to pay the filing fee for the work permit...however you STILL need to pay the $1070 for AOS if you file at a later date. So if you only paid 600, then you didn't send the proper payment.

Filing EAD at the same time or after i485, it means the fee is waived and the EAD won't cost anything. Filing it before means you pay the full price of it. No matter when it's filed, you still pay the full price of AOS which is 1070 dollars as far as I remember.

Resend the AOS WITH EAD+AP in same envelope and remember supporting evidence for EAD and AP too. Plus correct amount. It will be rejected due to incorrect amount whether it's a penny less or a penny more than the correct amount.

What visa did she enter on, and is her i94 still unexpired?

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

From filing I-129F petition until greencard in hand: 655 days

thats what happened to me incorrect fee so they rejected so I resent it with correct fee...You can send it together with I-765

just pay $1070($985 plus $85 Biometric fee)in one check....and don't forget the cover letter its easy for them to check on it..

This is why it is stated on VJ quite often to not bother with filing for EAD before AOS. It will cost you an extra $380 and be a waste of money because that EAD will expire when their I-94 does. You won't really even have time to use it.

The cost of AOS is $1070, with or without filing for EAD and AP. The fees for EAD and AP are waived when filing with a pending I-485.

Have her file for AOS and include the forms for AP and EAD. Use code (c )(9 ) on the EAD form. http://www.visajourney.com/examples/INS-Form-I-765.pdf
