Hey, I was wondering if anyone could answer a few questions we have as regards to starting our visa application.

We are currently living in the UK, my wife on a student visa from the us, and i live here. We got married a couple of weeks ago and wish to begin the visa process for me to live in the US. We are just confused with which visa to apply for. We have read that most usually apply for the K-3 visa and then the CR-1? Do we apply for the K-3, and when the I-130 has been approved we carry on with the CR-1 and abandon the K-3 route? Or is there anyway to just start with the CR-1 route, as its said to be faster?

Sorry for the newbie questions, we just want to get started ASAP.

Okay, the linked guide was for a IR-1/CR-1 visa. There is no switching, no K-3. I am not sure what you heard... Follow the guide linked above.

Perhaps you have been confused by topics stating that if a person tries to apply for a K-3, their two petitions will be tied together, one will be closed, and the pair will be on the CR/IR-1 path anyway. This is not something to strive for, because it makes things slower. Since the K-3 doesn't exist, it would make sense to get on the CR/IR-1 path straight away.

No there is no K3 option anymore. When you file the I-130 since you are married and than you waste time filing out the 129F (which was the K3 to married folk) it will go through USCIS as usual but what NVC does is close the 129F petition. No more does a K3 go faster so the government is slowly just making it go away. Once you are at the NVC you will be filing DS-230 which basicially now is the Visa application CR1/IR1.

All you have to fill out to get the ball rollin is the I-130 and the G325A. Read the guides for other documents and evidence you will need to send in though. Good luck.

don't even think about K-3. Just file CR-1 straight up. Don't complicated things on your own.

If your wife is in the UK with you at the moment then it may be an option for you to consider Direct Consular Filing (DCF) where she can file for your CR-1/IR-1 at the Consulate/Embassy in London. Check to see if you can satisfy the necessary criteria for this and it also depends on how soon you are looking to go and live in the U.S.

Don't even consider the K3 option as it is is obsolete. Good luck, keep us posted!
