Hello can you help me please, I am a Australian newly married to a US citizen.

We got married in the united states in October of last year and I had to come back because of my pension and housing..

I want to be with my husband..

I applied for a DS-90 was turned down because I overstayed on my visa waver by 9 days, and I was told I will have to apply for citizenship/residency.. I dont know where to start.. Ive been reading but there is so much to read, so many forms I just fluster and confuse myself.

I am on a permanent disability support pension here in Australia I have housing commission, but non of these things were taken into consideration when I applied for my DS-90.

Can you help me please? Do I have to change my name first in my passport and then apply for a I130? to be able to see my husband? Do I first have to inform Centerlink aka Social Security what I am going to do?

Do I have to apply for permanent residence I1-30 now since Ive been refused the DS-90 to be with my husband.. Can I apply for the DS-90 again?

Where can I go to get help?

What are the steps I need to take to make it to be with my husband..

Thanks,

Natasha

*** Moving from K3 to CR-1 spousal visa forum as the K3 is obsolete ***

Your husband will petition you, then you will apply for a CR-1 spousal visa. You being on disability will not matter- he is the one who needs to financially support you. If you have a costly ongoing disability, they may want to see that your husband has health insurance to cover you. Here is the Guide to what forms you need and when: http://www.visajourney.com/content/i130guide1

Keep in mind he will have to make a certain amount of money or have someone else co-sponsor you to come here as a permanent resident. He has to prove you will not be a burden to the US government and require government aid/benefits (medicaid foodstamps tanf)

Hopefully the links above will help give you some insight.
