So my fiance and I have received the NAO1 for the K1 Visa and we are expected to get the NAO2 in October. I have a few questions in regards to what the process will be like once she gets the NAO2.

1) It says we need police records of the previous countries she has lived in past 6 months. Can she start this process before we get the NAO2 since i hear this takes a long time

2) If i can not start the process before the NAO2, and the process takes 3 months on top of the NAO2, would my 90 day window be closed because of the delay and the process start all over again?

3) When you get the NAO2, does the 90 days start or is that once she gets to the US?

Thanks for your help with this. She is freaking out on me because she found this out today and I am deployed right now with very limited internet. Any help you can provide is very much appreciated.

Just be sure that the police certificates won't expire before your fiancée gets to the interview phase. I know some certificates are only valid for six months, so time it accordingly.

2) If i can not start the process before the NAO2, and the process takes 3 months on top of the NAO2, would my 90 day window be closed because of the delay and the process start all over again?

I think you're misunderstanding the 90-day requirement. The 90 days refers to the amount of time you and your fiancée have to get married once she enters the U.S. When issued, the approved petition (NOA2) is typically valid for four months and the consular can renew it if the interview has yet to occur by the expiration date.

Assuming you are in the K1 process.

When you get your NOA2, it will come with it's own valid time (4 months) until the visa is issued. I hear that time can easily be extended by DOS if time from NOA2 to Visa takes longer.

The 90 days clock only starts ticking after visa issuance at POE into the US.

This is amazing news! thank you for the help... really thank you! I just need to find some info on the police record stuff. She seems to think we have to go directly through the US Embassy @ Philippines. I was under the impression you just had to get them, didnt know we had to go through the Embassy. She also read some place about requiring the NAO2 to be done first before the police records can be obtained, that seems silly to me. Any light that can be shed on these is much appreciated. Thank you for this website, this really has been a blessing.

What everyone else said, plus:

I'm not sure if the requirements are different for the embassy you're going through, but you might want to double-check the details for the police certificate/clearance. In my recollection, the requirement is that the beneficiary present a police clearance for every country in which he/she has lived for a year or longer since age 16. I know someone, however, who was asked for records from a country lived in for only 6 months, so this can also be arbitrarily reinterpreted at the embassy.

Also, I wouldn't plan too much based on your projected NOA2 (which will be sent to the USC, not the beneficiary) date at this point. Processing times speed up and slow down randomly based on the weather, holidays, the price of wheat in Africa, sunspot activity, and other factors, so expecting the NOA2 in a certain time frame is asking for a whole world of frustration. Settle in and enjoy the ride. <---says someone who is past her initial projected NOA2 date by several months, just past the USCIS average I-129F processing time, and really not enjoying the ride that much at all...

No need to worry, I am just so happy there are so many people here willing to help. I may not have internet for the rest of the week so getting this information while I have it now is very good. Thank you again. I think i also found some info about the japan police record stuff:

My wife needed to get a PCC from Japan. We don't have a request letter from the US Embassy. I called the Japanese Consulate and told them we wanted to get a head start on this since their processing time states it can take up to 3 months to obtain the PCC.

My Wife took her passport thats it.

It probably didn't hurt that the guy she spoke with was the same guy I had called and made inquiries about it. He had originally stated we needed the letter from the embassy but I told him we didn't have it and we knew we would need the PCC so we were working to get it done ahead of time so as to not lose any more time waiting.

We picked it up a few weeks later.

I hope that will work for us as well, since she needs one from Japan and Singapore
