Me and my fiancee have a 2 year old baby that was born here in the united states, i allready sent my i-129f pettition myself but am worried i dont know if i sent the right information or if my pettition was filled right... I am so frustrated because ofcourse my fiancee is in México and my baby to! I sent my application may 21 and i want to know whats next and what aré my chances to get it approved... I am a women and i was in México for the past 3 years soo i dont have taxes and also i want to know about the afidávit of support... Help please!!!

Well for the I-129F packet you do not need to submit tax information. You do that during the interview stage. Do you have a job now that fulfills the poverty line requirements? If not find a co-sponsor you will need one for the interview stage. It would be a little easier to help with your I-129F questions if you let us know what you think you did wrong. You should go to the guidelines and see if you sent everything they ask for. If you didn't then start preparing it now bc you will most likely receive an RFE and once your receive that you want to submit the supporting documents asap. Let me know what questions you had so I can be of more help.

Get the child a passport ASAP. Do you have a co-sponsor from USA? It is possible both you and another sponsor fill out the i-134 so that you will not be denied on the public charge grounds.

Your chances of being approved depends on what you included, and if you included what was needed. If not, you'll most likely get an RFE.

Tax returns are needed at the interview stage at embassy. If you weren't required to file taxes, add a statement saying why you weren't required to file taxes, and start looking for a co-sponsor. Without US income above poverty limit, there's no K1. If you haven't secured an income after entering the US, you'll need a joint sponsor for AOS as well. It can be the same person who was the co-sponsor at the interview stage. The affidavit of support is the i-134 for the K1 interview, and I-864 for AOS(after entering the US). You will be considered as the main sponsor, so even when you have a joint/co-sponsor, you'll have to fill out the exact same paperwork as the co/joint sponsor.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

If you have lived in Mexico the last 3 years, why didn't you just get married there and use DCF(direct consular filing) for a spousal visa? It is faster and cheaper in the long run. Plus he would already be a permanent resident when he enters the US and be able to work and travel outside the US and re-enter. There is no need for AOS that way. For either the K-1 or spousal visa you will need to provide an affidavit of support, and if you do not have a stable US income that meets or beats the 125% poverty level for your household size of 3, then you will need a co-sponsor.
