hi guys,I had this post in another forum but I've got no responses,I am running out of time ,I had an appointment at Naples Italy embassy ,I was present there at the scheduled appointment time ,but the officer refused to give me the visa due to 2006 retrogression,according to visa bulletin my case will be current again within a few months ,right now I want to change my embassy to Ankara Turkey ,Is it possible to change the embassy as I once had an interview in the first one? ,what are the procedures I must follow for doing it if generally it seems safe and sound ? ,I should mention that there is no American consulate in Iran and choices for Iranian applicants applying for family based immigration are limited to a few embassies ,such as Naples , Ankara,Abudhabi, Frankfort,.. I am afraid I may have problem for getting my Schengen visa for Italy due to current Iran's relation to western countries ,although I had one before ,I don't want to have further risks and that's the reason I want to change it.I just want to know is it done via NVC or the first consulate ,or destination consulate ,what should I do help plz , (by Embassy I just meant consulate )

VJ is a place that members can only share their experiences with you. So please don't get mad and take it personal if no one is answering you, it might be that no one has any opinion about it. Moreover, VJ is a Do-It-Yourself website, meaning that there are tons of information and guides and stories on it, but you have to SEARCH for them. Have you ever tried searching for "Changing interview place" or "Changing the consulate" in the forums?! I bet you can find LOTS of info by doing this.

IMO call the Naples consulate and tell them that because of the hassle of getting a visa for Italy for Iranians, you'd like to change your consulate and see what they suggest. You can also call Abu Dhabi, Ankara or any other embassy that you want and ask them about the procedure of changing the place of the interview.

Be patient, your question is about a somewhat rare occurrence. Most VJ members have no experience with this.

My thought is to contact the Ankara embassy and ask if they would accept the case transfer. If yes, then follow their instructions.

I have seen your posts several times, but really don't have a clue about it! Remember, VJ is not a magic website that you get an immediate response whenever you have a question! VJ is a place that members can only share their experiences with you. So please don't get mad and take it personal if no one is answering you, it might be that no one has any opinion about it. Moreover, VJ is a Do-It-Yourself website, meaning that there are tons of information and guides and stories on it, but you have to SEARCH for them. Thanks for your concerns and reply ,I did have a search on VJ ,but to be honest none of the posts matched my case ,for others who had a success it was on primary stages ,before they even had an interview,but I actually had an interview. that's what makes it a little confusing but I will consider your guidelines ,I am just doubtful about calling Naples ,I think I may start by calling Turkish embassy.

I'm not an expert at all, but from the little research I've done to try and answer your question everything keeps pointing to the original (first) consulate.

Sorry but this is really rare so I don't think most people are going to have an answer.

I was going to point you to InfoPass as well, but you're outside of the US.

I would take this suggestion - ask one of these InfoPass embassies. if you're in Italy, the Rome one would be convenient for you. It's a USCIS office there that has power over your region of the world.

I'm just theorizing, but because your petition is likely already on hold at Naples, it generally can't just be "transferred" to a new embassy by informal request. I believe you need to file I-824 to formally request that it be moved to the new embassy or consulate, but first you need their consent that you're eligible to interview there. In our case, we're re-interviewing 4 years later at a different consulate so we actually filed a new I-130 because it's faster, but that's because it's an IR1 case. I believe if we were in your case, we'd have had to file an I-824. Frankly, because this is a situation that most on this forum aren't familiar with, it might be best to at least consult with an attorney who knows how to do this. Laurel Scott, link in my signature, has been handling our case and she is extremely experienced in complex situations like this, so I would trust any advice she can give you about this. She does a free webchat once a week, there's info about that on her website, and if you can reduce your question to a few sentences, you may be able to get a good starting point from the free chat.

thanks for your comment,I chatted with Laura today ,Laura says changing embassy is not a good Idea as it may prolong the process ,she said lawyers call the process "Stall tactics" ,of which is used to delay a case and can delay it to a year.I called another lawyer and he told me the same thing ,and a friend suggested not to do it at all as case may be lost.This is really embarrassing,maybe I just have to take the risk ,I wonder what would be the minimum time of case transfer,A year is really a long time ,1 year +(7 years up to the present),can this time estimation be related to lawyer's talent ?

Lawyer's talent has nothing to do with the time it takes for embassies to transfer paperwork. It's outside their normal activities, so it's a matter of just how fast they want to devote resources to moving your documents, which is usually pretty slow.

I think you have to forget about changing the embassy. Start preparing for your interview. You mentioned that you were denied before from the same embassy. Obviously, it's better to work on the reason of your denial and make sure to solve that problem before you go to your interview this time. Gather all the necessary documents/evidences/etc that reflected the officer's decision. I was gonna tell you this before: it is your best to resolve the issue that resulted in your denial than simply changing the embassy. If you have already done this, then don't worry because if you go fully prepared, they can't deny you again JUST BECAUSE you were rejected the previous time. Good Luck :thumbs:

OK, OK, sorry for my lack of information about your visa type and its procedure. I know how hard it could be to get a Schengen Visa for Iranian citizens :( It seems that you know all the possible consequences of changing the embassy. So I guess, no one can help you now. It's up to you to decide what would you like to do. However, my last piece of advice would be to consult with an immigration lawyer about your case to see what would they recommend. Sadly, I don't know one to help you :( but good luck :thumbs:
