My girlfriend is from Peru and I wish to marry her here in the U.S.

in early 2013. We have visited each other twice, once in Peru and

once in the U.S.

We realize we love each other after a year or so of talking and visiting.

We plan on getting married but she only has a tourist visa. We have been

reading and hearing about how long a fiancé visa takes to get approved.

Can we marry without a fiancé visa and the long wait, and still be legally

married, with NO chance of her being deported?????

Any couples who have done this, your stories would be greatly appreciated.

Well if you file today, you might make it with the fiance visa by early 2013. You can mary wherever you like, but if you marry in the US without a fiance visa, then you will have to file for a spousal visa after that and she will have to go home in the meantime. I'd file the I-129F today and keep a flexible date for a wedding in the US early next year.

i will not recommand you to choose this path. Reasons: when she applied the tourist visa, she has signed that her intention is to travel ONLY. if you decide to marry her and let her stay in the us with you AND obtain a valid identity, then you will have to wait for years after marriage to apply and the government has a bad record on her because she was NOT supposedly married with tourist visa, and there is a high chance of refusal when you try to get her an identity. if you want to married her here in the us but will let her go back to Peru and you will file the K3, that works, but again, what is the point? unless you want to marry her earlier, but you know you are risking on that move and create a bad credit for her. and K3 is usually slower than K1 generally.
