You could try to get the petition reviewed while it is still there, You will have to contract the consulate, your congressman and be persistant. The chnaces are small but worth it usually. Otherwise you are probably looking at six months on a shelf before you hear much of anything.

This will not be over quickly. You will not enjoy this.

MY QUESTION IS WHAT DO YOU DO WHEN THEY SEND YOUR CASE BACK TO THE USCIS FOR FURTHER REVIEW.

Are you the petitioner or beneficiary? If you are the petitioner and you are unable to keep the file in Lagos and it is ultimately sent back; one of two things will happen once USCIS receives the file and reviews it.

1) USICS will reaffirm their original approval and return the file to the Consulate for another interview (issuance of a visa is still not guaranteed)

2) USCIS will send a Notice of Intent to Revoke (NOIR) to the Petitioner (a more likely scenario)

If an NOIR is in fact received by the Petitioner, it must be responded to by the given deadline and the response must address all points in the notice. Failure to properly respond to an NOIR will result in revocation of the petition and a mark of misrepresentation being placed against the beneficiary.

April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

THEY ARE SENDING OUR CASE BACK TO THE USCIS FOR FURTHER ACTION. THEY SAID THAT WE MARRIED FOR IMMIGRATION PURPOSES ONLY. SHE DIDN'T EVEN LOOK AT EMAILS OR AT PICTURES OF OUR MARRIAGE.

1. Stop typing in ALL CAPS.

2. The US Consulate in Lagos Nigeria denied your visa, not the Nigerian Consulate.

3. Your first step is to have the foreign spouse write a complete and detailed report of the entire interview experience including the questions asked and answers given. You'll need this to have any idea of the actual reason they reached their conclusions.

Usually when visas are denied for with this notation, there are obvious red flags not sufficiently addressed, primary among those red flags is that the couple has spent only limited time together. Time to objectively evaluated the totality of your case. We can help if you provide the information but nothing is likely to happen in the next six months. Use the time wisely.

Write down the Questions asked from your man during his interview

Where there RED FLAGS like

Age Difference

Cultural difference (especially if you r white)

How many times you visited

Last time you visited

if you have passed Child bearing Age

Let the house know these.

Meanwhile you try to contact your congressman or Senator (It has worked well for some)

Call the Nigerian embassy to ask why (Try to Speak to a Superior Consular)(Worked for Some)

Dont Lose Faith- It has worked for some
