Hello to Everyone out there going through the visa process who was denied on their first interview. It is a tough time to go through because of the uncertainty. We all do what we can gathering as much proof as possible. Then when our spouses get to the interview, they meet officers that refuse to look at the proof that was gathered between the time the petition was filed and the time the interview takes place. The petition is sent back to the USCIS. Some people wait months, we waited 5 months, for the petition to get sent back to USCIS. Then once it is received, we wait another 5 months more or less.

We have no idea after waiting through another year if the visa will be approved the second time. If we give up our jobs, our homes, our family to move to our spouses country, we may have an even more difficult time getting approved if we do not have someone else willing to take the financial burden or if the Embassy does not like the fact that the American spouse has no means of support. Hands seemed to be tied. Decisions are tough to make.

I hope there are some experienced long time VJ'ers out there that will give positive words of hope to those of us that are in so much pain. Positive outcomes that others who were reaffirmed and received 2nd interview would be nice to read about.

Hi,

After 15 months in AP we found out our petition had been denied. Our case was sent back to USCIS with great speed and we received a NOIR. We were not expecting the NOIR so soon and were caught off guard. We only had 30 days to respond so we hired a lawyer and got to work getting our proof of relationship together. We were able to win our appeal and are waiting for our case to show up at the embassy for another interview. My husband and I have had a long difficult road with immigration. We have been trying to get his visa for almost 3 years.

On the positive side getting the NOIR tells you what problems the embassy has with your case. I feel that my husband has a good chance of getting the visa because he will be able to address these issues at his next interview.

We all put ourselves through this because we love each other and can't see going through life without our soul-mates. There are people on VJ that have had second interviews and gotten their visas. If I didn't have hope of my husband getting the visa this time life would seem so bleak. I was so happy when our case was reaffirmed and I still feel that happiness.

Thank you so much for the positive response. These are the kinds of stories that those of us going through this process can read and these stories will help us hold onto hope. God is Great!! I wish you and your spouse the best. I am proud that you have continued to keep a positive attitude. We are blessed to have found our soulmates and we should never give up on making the best choices possible in order to spend a happy life together.

We were denied in 2009. We were flagged for fraud,material misrepresentation , and a non-bonafide relationship. We received our action to deny a little more than a year latter. I overturned ever allegation without a lawyer and we were reaffirmed. We were denied after our second interview for an unresolved arrest, and the need to show proof that he didn't have any immigration proceedings against him for deportation. The required documents took me a year and one month to get. By that time our second interview was void. Our third interview is coming up on July 17th. We have all of the paperwork requested and are hoping to be denied only based on his overstay so we can submit the 601 waiver. We submitted our application in November 2008.....still waiting.
