Hi Everyone,

My wife and I filed for her visa in January, 2012. It has felt like an eternity, but we finally received our NOA2 last Saturday! Anyway, until now we have felt as though we were in limbo. Without any specific dates or even good estimations to work with, we have not really been able to make arrangements in our personal life, i.e. house, job, work, etc.

My question is this... following the final interview (assuming all goes smoothly and the visa is granted) is there a certain amount of time that my wife will have to wrap up her business in China before coming to the America? Or is she expected to drop everything and jump on the first plane out? It would be wonderful if the latter was practical but she needs to make arrangements with the university she teaches at, as well as finishing and finding tenants for our new apartment (among other things). Because it had been impossible to make these arrangements without having some relatively concrete sense "when" things would happen, we now find ourselves in a mad dash to get it all done. I am just concerned that it may not be possible to do it all before the final interview. If she needs to stay a little longer, what are the rules? How much time would we have?

Thanks in advance for any help,

Like Xanax said on K1 you have 6 months to finish your business, my wife spent about 2/3 months and just recently went back to see family. It will all come together. Good luck.

In Arizona its hot hot hot.

He said 'wife' so I am going to assume it isn't a K-1

OP - there will be an expiration date on the visa your wife gets at the interview. She must travel before that time. Generally it is 6 months but often that is dependent on the medical she had.

Please look at that when the visa is issued. Becuase it is a Cr-1 it is possible for her to travel to the US, get her I155 stamp and turn right back around to go to China to finish her stuff back there

Good luck

They say 'congratulations, you've passed, we'll send you your visa in the mail'... and it shows up a week or so later, with a six-month expiry date. If there's some real reason you can't use it in that length of time (like a family member has a terminal illness...) you can apply for an extension for ANOTHER six months, but it's frowned upon. Having waited a year or so to get the thing they really expect you to be ready to make your move inside of six months after they approve you. I got my visa in June and flew out in November.

Don't forget you can go slow at NVC, even when using Electronic Processing. You've a year on each thing to submit (after OPTING IN) , so that's a year for the AOS, a year for the IV, but YOU must keep in touch with NVC and remind them that you are still interested in pursuing the IR-1 visa.
