Hello visa journey.. I need to ask something, what to put on I-765 question number 16, it says go to part 2 instructions, eligibility categories, in the space below, place the letter and number of category you selected from the instructions, for examples, (a)(8),(17)(iii), etc. Eligibility under 8 CFR 274a. 12....she's holding a K1 visa and she wants to work as soon as possible.... Has anyone could help us?we really appreciate.... hoping for your reply...tnx! :help:

This should go in the AOS forums, not K-1.

If she's applying for the EAD at the same time as the AOS, it's ( c ) ( 9 ). Read the USCIS instructions of this form carefully. This is a frequent question on VJ, a quick research in the search bar and you would have found your answer.

Are you married yet? If not and that you want to submit the EAD form right now, be aware that you're going to pay the fee and the EAD will be only valid until her I-94 expiration date. It takes 2-3 months to receive it so she may receive it few weeks before the expiration date or even after. This option is quite a waste of money. Best is to file for EAD at the same time as the AOS, this way the EAD form fee is waived, and the received EAD will be valid for a year.

Get familiar with the AOS from family based visas forums, you'll find all your answers before even asking them. ;)

When filing with your I-485 the category is (c )(9 ).

If you are filing it alone before filing for AOS, then the category would be (a )(6 ). However, do not bother with filing it on its own before the I-485. It will cost you $380 and it will expire when her I-94 does. It takes 2-3 months to process, so she will not really be able to use it to work anyway. It is a waste of money. Filing it with the I-485 makes it free and the EAD you receive is valid for a year. http://www.visajourney.com/content/k1k3aos
