Hi All;

I am a natural born US citizen residing in California.

I married my Filipina fiance in Calgary, Alberta in October 2011.

She is there on an "open work permit" (does this make it more difficult because she is not close to her home Phillipine Embassy)?

Our goal is for her to come live here with me.

From all that I've read about the K3 Visa, do I bypass the IR Visa and 184 documentation?

My understanding is that I do the (in this order) 130, 129, 325, physicals, interview, done.

Is this right?

Your order is incorrect (form G-325 is included with the I-130) as is the follow on form (I-129F, not I-129); however, this is a moot point. My explanation why is below.

After filing the I-130 and other required forms and documentation, if you were to subsequently file the I-129F, USCIS will tie the two petitions together by pulling the I-130 from its current place in the queue and place it with the I-129F that was just filed. The two petitions are adjudicated together and a decision on both comes at the same time. If both petitions are approved, they are usually sent to the NVC at the same time. If the NVC receives both petitions at the same time or if the I-130 is received first, the I-129F that was filed to start the K3 process is administratively closed leaving only the I-130 active which places your case on the CR-1 path.

The fact that she is a citizen of the Philippines residing in Canada has no bearing on the petition in any way, shape, or form (i.e. it does not matter that she is far away from her "home Philippine Embassy"). Since your wife legally resides in Canada, she will be able to interview in Montreal. Furthermore, electronic processing through the NVC is available for cases going through the Consulate in Montreal as is the use of online forms (Electronic Processing is option, use of online forms is required).

Yes and I'll just add some clarification. Neither the Philippine Embassy, Canadian Embassy or ANY Embassy will be involved in the process of the OP's wife immigrating to the USA. If she lives in Canada and intends to continue to do so, it will be the US Consulate in Montreal involved in the visa process, specifically, the Immigrant Visa Unit at that Consulate.

The only US Embassy in Canada is on Ottawa. They don't get involved in issuing family based visas.

Facts are cheap...knowing how to use them is precious...
