Hi, me and my fiance is in a very hard situation. We met seven years ago online and we saw each other in person for the first time this summer. It was everything we knew it would be, it was right and perfect and we worked even better in person. He proposed to me when i got there, we both know we want to live together forever but we have so many struggles. I'm from sweden and i'm taking care of my mom that's sick, and he's stuck in america with debt and a job that won't give him enough time off in a row to travel. So while we can't live together right now, we miss each other terribly and every day apart is painful. So the only thing we can do right now is to have me come over for visits. I'm extremely concerned about this cause I had a very tough time getting through customs without even mentioning the word "boyfriend". I have no ties back home to sweden, i don't have a job or my own place or car, i don't even have a cellphone! we have decided that the only way is honesty so we will say that we are engaged and im planning to see him but also to come home, which is true, but im so scared of being denied. It takes so much time and effort for us to save for one ticket so one denial is an extreme heartbreak for us so I want to do everything I can to make it go as smoothly as possible. My questions are:

1, do you think it will be easier for us in our travels to be engaged or married? what makes it easier to get through customs? and when it's time to take the big step, is it easier to get either the fiance visa or spouse visa approved? Do you think it will benefit us to get married in america and me returning home as it shows that im planning on going the legal way?

2, when i enter america the next time, should i say that we are engaged and im coming in for an engagement party and we will have the wedding on a later date, or should i say that we might get married at this time but that I will return home? We might get married but we aren't sure, but i will for sure be going back home after. I'm worried if i say the word married in america the customs will send me home right away, but I don't want to lie...

3, how can I convince them that im returning to sweden without a job or school or my name on the lease? can i get my mom to write a letter? anything that might help? Im EXTREMELY terrified of flying and also being denied entry so that might make me seem really suspicious, so that adds to my worries as well....

The best thing you can do is be honest. Don't tell them your life story,tell them answers to their questions, don't add extra info unless asked.

Bring anything you can prove as a tie to home, lease agreement, letter from your employer, could you get a letter from your mother's doctor to say you are the primary caregivers and will need to return to care for her?

In regards to the K-1 (fiancée / fiance) or CR-1 (spousal visa) they both take similar time to be approved and they both have pros and cons =/= Check the comparison guide above to help you decide which is best for you.

Hei there,

There are several ways of seeing it, most importantly, from the CBP officer's perspective who determines whether or not to let you enter US.

Your issues are no lease, no job, no income and basically travelling alone without the funds to do so.

There is not one single thing you can do to not be refused/denied entry however you're travelling alone is the first thing the CBP officer would notice. I'd choose an easy port of entry if I were you however that doesn't eliminate anything - just you being less nervous and more confident might have a different outcome. See if it's possible for you to be added to the lease. Your mom writing a letter might not do the trick since she's not a third party however does she have anything in writing from a doctor or hospital about her illness/being sick?

Being married to a USC ties you more to the US than your home country. When being asked "business or pleasure", it's just a matter of saying "pleasure". If being asked more, then answer truthfully. Your purpose is to see your fiance and then return to Sweden. Your return ticket will back you up here.

I don't want to scare you nor give you false hope. However the officers have been trained to read you and your body language. If you do too much research and read too many denial horror stories it will most likely reflect on the way you act. Your best shot is simply being prepared by knowing what to do in case you do get denied.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

It will be against the law to get married after going in with a tourist visa, you would want to do that either with the K1 or elsewhere then apply for the K3. If you do get married going in with a tourist visa, you risk deportation and also risk re-entry denial.....it is not against the law though to get engaged. Whatever you decide, good luck.

No. It is not illegal to get married on a tourist visa. It's not illegal to plan a wedding being on a tourist visa either, or before even visiting. You cannot be deported simply for planning to marry on a tourist visa. What is considered a no-no is entering the US on a tourist visa with the intention of staying. Most people just know that the only way to legally stay in the US on a tourist visa is getting married for the purpose of staying. Hence immigrant intent, and immigrant intent on a tourist visa will get you refused entry, NOT for marrying.

so...um...where did you read it was illegal to get married on a tourist visa?

Op - being married or engaged to a US citizen can often lessen your chances of entrance into the US. While being truthful is a MUST, do not divulge any more information than necessary
