We are preparing our joint sponsor's papers. About their household size, it's their own household plus the intending immigrants (plus any other person they have sponsored before), am I correct? Do they count my daughter who is immigrating with me? We filled out an I-864W for her, which means she is exempt from the I-864 requirements, but I'm not entirely sure what that means.

I'm thinking NO, because there's nowhere to count my daughter on the form (I think)?

04/05/12 - NOA-2

Does your daughter qualify to be a US citizen? If no, she needs to be sponsored as well. If yes, she needs a US passport, no sponsorship required.

The I-864W is unlikely to apply to your daughter.

We filled out an I-864W for her, and apparently it's the correct form to use, only my husband made a mistake when signing at the bottom part of the form. She doesn't qualify for CRBA because her father hasn't met the residency requirements to pass on US citizenship. But I believe she will become a USC upon entry into the United States as an LPR (Child Citizenship Act).

If your daughter is the natural or adopted child of a US Citizen but does not qualify for citizenship until she arrives in the USA, AND she'll be coming on an IR2 visa, then the I-864W is the correct form. She will NOT count in the joint sponsor's household size.

Another question, but unrelated to the topic. When she gets US citizenship, does she lose her Philippine citizenship like what happens during naturalization?

Her Philippine citizenship is NOT impacted in any way but she will not "Naturalize". You just apply for a US Passport for her and that becomes her evidence of US Citizenship. She can GET a certificate of citizenship in her name but it is expensive and not needed, since she can have a passport.

I only earn roughly $2,800/month ($1,400/2 weeks). Thats $2800 x 12 months so around $33,600 annually. Am I correct or not? My ITR last 3 years, I only make $30-$33,000.

For the affidavit of support, you use the gross income. When paid every two weeks, you multiply $1,400 X 26. However you said you earn 22 dollars an hour and work full time. If full time is 40 hours, then you calculate your gross income as 22X40 hours a week 52 weeks = $45,750

Whatever the real number is take your gross hourly times the number of hours you work per week, times 52 weeks in a year.

124% OF the poverty level, not 125% ABOVE the poverty level is the correct number for any sponsor of an immigrant. Though the I-134 technically only requires 100%, approval is a judgment call made by Consular Officers who know the intending immigrant is going to need to have a qualified sponsor at 125% in order to successfully adjust status.
