I have been married for over four years and almost a year ago applied to have my conditions lifted from my greencard and did the I-751 application. In February of this year I heard back from Immigration saying I needed to provide more evidence of a bona-fide marriage. The issue is my husband and I do not have many of the examples they gave, we do not file taxes together or have a joint bank account due to a situation he is currently in (on advice of a lawyer we keep our finances separate), we live in a family owned house so we do not have a lease, and we do not (yet) have any children.

This time round, We sent in gas bills dating from before we were married but were living together, we sent in proof of a shared medical plan we had in 2008 which we stopped because it was too expensive, we sent in a new medical plan we both now share through a position I only started in February of this year. We sent letters from our lawyer explaining why we do not share our financials and letters from our family members regarding our living situation, plus rental checks to the family members.

We sent in about 30 letters from people who know us in support of our marriage and we sent in itinerary from our trip to Europe last summer. We also sent in wedding invites to us both and some cards for holidays and our anniversaries. I also included many work related emails to my husband addressed to me (I manage some of his travel arrangements and financial arrangements for his work).

I am really nervous this will not be enough, because we do not have the more clerical things they desire. I have not heard anything back and it has been a while, so I am getting nervous that they will reject my application. I would even be grateful if they asked us in for an interview then we could explain some of this stuff to them. The 60 day waiting period is up next week.

Any advice is greatly appreciated.

What the adjudicator is looking for is evidence of an ongoing co-mingled married life. Bills from before marriage are not relevant.

I assume that you actually live in the same place. So there should be many every day pieces of your lives that show this. Drivers license, car registrations, utility bills, life/car/health insurance policies, credit card bills, mail addressed to the both of you, bank statements (joint or individual), memberships, etc.

Passport stamps and boarding passes are better than an itinerary.

A few letters from friends and family are just as good as 30. Why would a person submit an affidavit that isn't positive?

What the adjudicator is looking for is evidence of an ongoing co-mingled married life. Bills from before marriage are not relevant.

I assume that you actually live in the same place. So there should be many every day pieces of your lives that show this. Drivers license, car registrations, utility bills, life/car/health insurance policies, credit card bills, mail addressed to the both of you, bank statements (joint or individual), memberships, etc.

Passport stamps and boarding passes are better than an itinerary.

Thank you for your thoughts, we did send copies our joint health plan but we don't have a car (we live in the city), I don't even have a license! I have never had one my whole life! My husband does not have a bank account, though I do and though it is not joint in name, I could show deposit slips of his checks going into my account. We don't use credit cards, we are not members of anything, but yes, we live in the same apartment, I basically manage the administrative side of his career, I have even been mentioned in articles about him and his family (musicians) as his wife. My fear is we do not have many of the more traditional documents, and I am not sure what to do and if it is going to be an issue.

Not to sound mean or dismissive, but it sounds like all that you can prove is that you are a live in administrative assistant. Dig into your records and find more proof. A preponderance of little things is what you want to show. This stage (removal of conditions) wasn't a surprise. There was ample time to save/prepare.

Not to sound mean or dismissive, but it sounds like all that you can prove is that you are a live in administrative assistant. Dig into your records and find more proof. A preponderance of little things is what you want to show. This stage (removal of conditions) wasn't a surprise. There was ample time to save/prepare.

Do you have a state ID? That would also be a great way of showing you live at the same address. You really should get one of those if you don't.

Did your husband file for bankruptcy? Is that what prevents you from having a co-mingling of finances? If so, I would look into getting a credit card and putting him on as an authorized user. A joint application will likely be denied if he has bad credit.

Income tax return transcripts are fine, even if you file as "married, filing separately"
