Well looking at the totality of the situation you have of course many red flags.

When the CO's look into a case remember cultural norms and traditions are key. I don't know about Irans culture and traditions so about marrying your first cousin is that a norm. I know for India or Pakistan its no big deal (sometimes).

Now his two denied student Visas really shouldn't be an issue since many of us have SO's who applied for student visas, tourist visas and were denied. Especially when they came from high-fraud country.

But if I may ask what was the reason for the denial of his student visas? As long as there is no misrep it shouldn't be an issue.

Lastly his country Iran, this is also a tough embassy and high fraud he will probably go into mandatory AP after interview for more checks.

But just some food for thought.

Thank you. I've heard that if you DO admit you are cousins, you will (God-forbid) certainly be denied because it is against the law. Is this true??

'the law' to follow here is the law of the state where you reside,

as 'the law' isn't a federal one.

So, what's the law, on the books, in the state where you reside, about cousins to marry? Yes, I am asking you to do more research, but, IMO, that's useful for ya.

Ultimately, the Visa Officer at the IV Unit will have done the same research, and will know whether or not this marriage is lawful or unlawful for the state where you reside.

To be honest, i really don't know if it's legal in the state where i live. I live in Florida. A lot of people said in this forum that it IS legal in the state of Florida, but i'm really not sure. Where can i found this out?

We were married in Iran. we have a marriage certificate and everything. We have applied for a IR1/CR1 visa, and are now in the process of the NO2 stage. I will definitely take everyone's advice about being honest at the interview. I reallyyyyyyyy hope everything goes well, and I hope that noone asks anyway. :D.

Thank you everyone for all of your advice. At least it calmed me down for the time being. :D i will always be nervous. I can't wait to start my life with him! Good luck to all!!

study a bit, with the county clerk's office where you live. They most likely have a website, and in that website, is some reference and definition to 'the law' for those who are legally able to marry in the state of Florida.

Hi All,

I am a US citizen and my husband is a foreign citizen.

The question here is this---my husband is my cousin. In our foreign country, if there are no genetic issues, then we are legally married.It wasn't planned, we just fell in love. We have been in a relationship for 6 years---(I went to see him every year, lots of e-mails, phone calls, etc). I was the type of person who NEVER thought i would marry my cousin. I was born and raised in the US. We love each other dearly.

I am nervous that at the embassy, when they ask if we are related, what should he say??

He applied for a student visa two times, and both times he was denied. (i told him to apply for the student visa because that could be a way for us to be together--we were too young to get married).Now, I am 24 and he is 25. On one of his student visa applications, he wrote that he is going to live with his aunt in the US (he wrote down my US address).

When asked why he applied for a student visa, what should he say? And if they (god-forbid) look further and ask him why the US address he used for his student visa (the one he said he would live with his aunt) is the same US address for his wife, what should he say??

I am sorry if i have confused anyone. I love my husband dearly, and we have been together for almost 7 years now. PLEASE HELP! Thank you!

It's not clear whether any petition has been filed yet but the I-130 asks if you are related. Always tell the truth. Lying on an immigration form or to an immigration official has extremely serious consequences up to and including prison for the US Citizen and lifetime US entry ban for the foreigner.

If you already lied on the I-130, not good. If you haven't filed, just tell the truth.

Facts are cheap...knowing how to use them is precious...

A man may not marry any woman to whom he is related by lineal consanguinity, nor his sister, nor his aunt, nor his niece. A woman may not marry any man to whom she is related by lineal consanguinity, nor her brother, nor her uncle, nor her nephew.

"Lineal consanguinity" here means mother or father. No mention of cousins (first, second or otherwise) is made, therefore first cousins may marry in Florida.

The reader should call and confirm anyway, but better forewarned and forearmed when dealing with government flunkies I find. ;)
