Hi everyone,

My fiancee has passed his interview.

QuestionS I have now about him is :

1) IS HE ALLOWED TO WORK IN US ONLY AFTER COURT MARRAIGE IS DONE.

OR IF HE CAN WORK BEFORE THE MARRIAGE TOO.

2) WILL HE WILL BE GRANT A WORK AUTHORIZATION OR WORK PERMITT @ THE AIRPORT.

I posted this in the Working and travelling forum with a similiar question ...

Well K-1 Visa holders are allowed to work for the length of the I-94 (which is 90 days from your date of entry into the US) ... You have to wait approximately 10 days before you go apply for your SSN card ... Once you receive your SSN card you are able to work (again until your I-94 expires) but the problem is most employers will not hire you as you are unable to actually prove that you are allowed to work (unless you managed to get a temporary EAD (90 days) at your POE which not many do anymore) ... It really depends on the employer if you will be able to work during the first 90 days without your temporary EAD ...

Once you are married you should apply for AOS and EAD right away so that you can get either your 1 year EAD or your 2 year conditional GC ... Because if you do not get this in time then there is the chance that you may have to stop working until you receive one of them (once again this is dependant of the employer) ...

Before if you get temporary EAD at airport, or after getting EAD from USCIS
2) WILL HE WILL BE GRANT A WORK AUTHORIZATION OR WORK PERMITT @ THE AIRPORT.

Only some airports stamp passport wit temporary 90 day EAD, such as JFK in NY, but JFK may stop doing that soon also.

I just came in through JFK 3 weeks ago and I did get my temporary work permit. I would try to get a flight over JFK and than you will have a good change.

Hi Milka,

Did u asked the immigration officer to stamp ur I-94 that authorization to work? My POE is JFK too, last Sept 20, and there's no temporary working permit on my passport/I-94. Would I still be able to let them put a stamp on it? I have a job call in LabCorp, & i do really want the job. Thank you.

Maybe not. He can submit an I-765 immediately and begin working with the receipt for that. He'll have 90 days to show the EAD itself (by which time it will have expired, if he ever receives it, but so what?)

You can not go back and get the temp work permit.... if you did not get it at POE then all you can do is wait for the EAD you filed for with your AOS....
