Changing marriage status after applying N-400

I was struggling with myself last night that what I should answer when officer asks why you didn't let us know about your divorce. It seems stupid but the only answer I have and it's true is I just forgot it. I hope it's convincing enough for them.

I will keep you updated after my InfoPass.

Since you are not applying based on marriage, you should be fine and this should not raise a red flag with them. Just explain that during the excitement of the interview, you forgot to update your marital status although you had all the paperwork with you during the interview.

For your Update, I went to immigration office the day before yesterday with my Info pass appointment letter in hand. I explained my situation for officer and wanted to show my divorce evidence. At first she thought I have applied for my citizenship based on marriage and said you need to go to resolution table the day you go for oath ceremony and they will decide about it. But when I says I applied based on 5 years she reviewed my file again and said so why you are here? because you are fine and we don't care if you are still married or not. I explained for her that in my certification my marital status will be married but I'm divorced now and I need to fix it. She replied you can pay about $300 anytime and fix your certificate but you don't have to do that. then she explained that the marital status in your certificate is just for tax purposes and from now if your employer wants to hire you it's your responsibility to tell them that you are divorced because your certificate shows you are married.

Any way I will show my divorce paper to an office on June 20 in my oath ceremony too.

Hi everybody,

I'm writing the update for any person who has the same as my situation.

In the oath ceremony I took my divorce paper. In the back of oath ceremony letter, There was some questions that one of them was if your marital status is changed after the first interview. I checked that question "Yes" anyway and wanted to show my paper to anyone who is interested to see that.

When an officer checked my paper to let me go inside, He asked if I'm applying based on 3 or 5 years. I said 5 years. Then he checked the no on that question and asked me to initial there.

So obviously they are not interested to your marital status at all if you are applying based on 5 years.

But in my certificate still is written married! The officer in InfoPass had told me that I can change my name or anything in my certificate anytime by paying $300 and send a request with proper forms.

Thank you RS232, your info helps me. But I had my interview done and the following week I had to sign the divorce agreement and file it then I had received the divorce final papers and the oath date both on the same date which was a week after I signed my divorce papaers, surprising is I got my divorce finalized in one week. but my oath is in two weeks so I was confused and after searching I found your post, I had the similar logic so I will carry my divorce notice to the oath place along with me.

my situation is I didn't apply based on marriage also I had been on permanent resident for 15 years so hopefully it will be okay for me too as mentioned above. Thank u so much for the info. I will update if any different.

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
