No. It is not true.

1.) You sponsored the child on a K-2, any means tested benefit can not be drawn on his behalf.

2.) just because you married his mother does not mean he gets SSI, whether wife/child were immigrants or not.

3.) The only thing his mother is entitled to is Child support from the biological father. How that works internationally, I have no idea.

4.) TANF advance child support payments through your state are a means tested benefit also. Again, which can not be drawn on his behalf. (I think this is what the person who gave you the information means)

I am a bit confused on something. I was told by another immigrant here that since I (USC) married my K1 wife and she has a son (K2) that we can draw some kind of assistance or Social Security for him since he is not my biological son?

Is this true?

What can be done depends totaly on your age. My husband retired at 62 which triggered SS benefits for myself and daughter which is his step daughter. These benefits are affected by her age ( 15 ) & remain in effect until she is 18.

See your SS office for more info or the web site where my husband found out about this.

If applying for social security retirement, then yes, both your wife and step child will receive benefits. The step child does not have to be adopted, just a member of your household and claimed on your tax returns.

For SSI benefits, the step child is NOT eligible.
