Help filing 864 sponsor form

Hi Friends,

I have very straight and simple question regarding filing I-864 form

Case: I - non US citizen on Valid F1 visa.

Wife: US citizen and going to sponsor 864 form for my AOS.

We both are graduate assistant working on PhD since 2009. We both make around 23K annually.

My wife used to file taxes along with her family for 2009 and 2010. But for this year she filed for her own. She is going to submit copy of her 2011 tax return along with 8864 form.

My question is that will it be a problem if she does not have above poverty line income in 2009 and submitted taxes with her family in 2009 and 2010?

No, current income is what matters. As long as she makes enough now.

and the answer is no, they don't care

as long as you filed taxes for 3 years and you made enough money last year.

Indeed...she is not even required to send those records in. She is only required to send the last year. You no longer are required to send in three years worth.
