Timeline

I got a letter on August 11th saying that they would send me a new RFE ( because the first one got lost in the mail and never arrived). IT didn´t say when it would be resent. It has now been 60 days since that day and no letter has appeared. What are my options? Should I wait longer? What should I tell the people when I call the USCIS? I called once adn they said that I couldn´t do anything about it, and I called another time and they said to wait longer.

2/20/2007--K-1 interview and approved visa!!!

3/14/2007--entry into the U.S

3/19/2007- civil wedding

3/21/2007--OAS papers mailed off

4/21/07 Biometrics appointment

6/20/2007--AOS interview in sacramento--almost aproved

I would continue calling and insisting A LOT, letting them know you have waited for a long time to recieve your RFE in the mail. You need the RFE to arrive to know what they want, it may be IMBRA info. or maybe something else, let us know what happens.

This may be a silly question, but did you verify they have the correct address? I think the email you received regarding the RFE states that you can request them to send another after 30 days, and for you it's been nearly 60 days if I understand your post. I'd be on the phone to my congressmans office.

Another option I just thought of, perhaps others could comment, would be to just get a copy of the IMBRA supplement for pre-IMBRA applications and send it in with RFE marked on the outside of the envelope, and include a cover letter stating that you never received the original RFE in over three months.

I don't know if this would work, but I'd sure try it and in the mean time, contact your congressman.

Maybe someone here has a copy of the blank IMBRA rfe they could send you, or know where you could find it online.

I understand how you feel. I got the email that my RFE was sent on 9/11/06 and I've never received it at home either. Luckily for me, I hired a visa attorney and he also receives a copy of everything that goes to me.... He ended up sending me his copy of the RFE (it was just the IMBRA one) and I over nighted it back to them the next day (last week).

FINALLY, a full week later, they sent the standard email saying they had received my RFE back and are continuing to process my case.

If I were you, I'd find a copy of the IMBRA RFE and fill it out and send it back. You might be lucky and find that is all they've asked for. MAKE SURE you put a cover letter in there with your proper address verified so they can double check their files at that end to ensure it is going to you at the right place.

Of course another option would be to fill out the NEW I-129-F form that includes the IMBRA questions, mail it to the CSC with a cover letter asking them to use it as an ammendment to your initial petition with a photo copy of your original receipt. Explain that you have been waiting for 60 days for your RFE and it still hasn't arrived. That may help, it may not...

I-129 submitted on 5/26/06 (on OLD forms because the new ones weren't out!!)

NOA #1 with receipt number dated 6/12/2006

Nothing else has happened after that as far as I know... No RFE's, Nothing?

Email notice on 9/11/2006 that my question would be answered.

Email notice on 9/12/2006 that the RFE is in the mail 3 months after my WAC number

Next trip to see her for a week on 9/23/06...

Went to Colombia on 9/23 returned on 10/1

I never received my RFE but my attorney sent me his copy which I filled out and overnighted on 10/3 RFE delivery confirmation on 10/4 but nothing from CSC yet...

CSC Email saying they have my RFE on 10/11/06, a full week after they got it.

Note that to this day, I've still NEVER received my copy of the RFE they said they mailed to me! I've seen lots of posts about lost RFE's and other documents from the CSC! This concerns me greatly!

NOA 2 on 10/18/2006 Woo Hoo! 129 days from NOA 1.

Yesenia arrived in the US on January 18th, 2007

We were married on 3/17/07

Filed for Green Card and Employment Authorization right away.

Green Card was issued (with EAD card) on 6/15/07

We'll be filing for AOS pretty soon.
