Hello Dear Visa Journey Friends,

My wife and I are applying for her I-751 "petition to remove conditions on residence" form and going through the packet to send to the USCIS.

Her green card is current until 6/29/12 and we are planning a trip abroad between 5/26 and 6/18. We are planning on submitting the I-751 packet in the next few days.

SO, our question: Can we take the trip in the meantime while her packet is processed? or is there a reason (which I don't see one) that we need to stay in the USA for that time period (and her green card is current until we return)?

Not sure if anyone had a similar question/issue, and I could not find a thread, so I started a new one.

Your help is greatly appreciated!!

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

The only issue might be being scheduled for biometrics while you're gone. So make sure you have someone checking your mail :) Also make sure you carry the expired GC and the ORIGINAL ROC receipt letter (extending your status)

Well her GC does not expire until 2 weeks after her return to the US. Our only concern is the biometrics appointment date.....if we send something in April, what are the chances that appointment might happen at the end of May or the 1st 2 weeks of June?? :)

Honestly there's no way to know for sure. Some people have waiting a month for NOA1 and some just 2 weeks. Some have waited a month (from filing) for the biometrics letter, some 2 months. Some people have their fingerprints rejected and need to go back again.

I suggest filing as soon as the window opens and seeing what happens. Trying a walk-in for biometrics (if possible) and rescheduling if you need to.

Thanks a lot.

I just finished the packet and we are planning on submitting it by the end of this week. Her window just opened up on 3/29. She will be gone from 5/26-6/18 and hopefully the time will not fall in this frame, but if it does we can re-schedule I guess....
