Timeline

I'm taking my husband's last name and so far, I have his last name on every form for the AOS/ EAD as my last name. However, my last name hasn't yet been changed with the social security administration. We will obviously be sending in a certified copy of marriage certificate which will have us both with his last name. Will that suffice or should we hold off on sending in the paperwork until my name has legally changed with the SSA? Please help as my husband is going a bit stir crazy at the moment and wants to send everything ASAP so he can work sooner rather than later. Thanks in advance!

File your AOS paperwork in married name. No need to wait on SSA.

If your I-94 has expired, then SSA probably won't let you change your last name until you have your EAD anyway. Your name is now legally your married name, as of the day you got married (if you choose to change your name), it's just that SSA doesn't know about the change until you have it changed in their system (same as any other institution). SSA will need to see your original EAD, so you will most likely not be able to do the name change by mail anyway, you'll have to go into an office in person. SSA only accept original documents or copies certified by the issuing agency (in this case USCIS). So file AOS in your married name, and then wait for EAD to update SSA.
