I134 - Need Help Urgently

Hey All,

Just getting the final documents prepped for my K1 interview in Montreal. My hubby-to-be is self employed. His tax return for 2011 will not be ready for my interview on April 25th as he is filing for an extension with the IRS. Will this be a problem if I bring his return for 2010? What will I need to bring to show the consulate that he has filed for an extension? Also, is it net or gross for the amount of income earned that has to be entered on the I134?

As well, should I bring tax transcripts for 2008 and 2009? Is there something specific on the transcript that I should bring?

Has anyone who has done their interview in the last couple of months had to provide the I864? I keep getting conflicting information that this is not required until we have filed the AOS.

I'm panicking at this point and scared that this might not be sufficient for the consulate.

I also did up a letter of self employment for him...know that this is not required but I figure it can't hurt.

Any help would be great. Thanks

You will need the form your husband filled out for the accountant that shows he filed for an extension. IRS Form 4868. Having that form and the 1040 return will be fine.

Take all the pages of the '09 and '08 transcripts. You need the I-134 for the interview. The I-864 will be after you come to the US and apply to adjust your status.

You will need the form your husband filled out for the accountant that shows he filed for an extension. IRS Form 4868. Having that form and the 1040 return will be fine.

He uses the TOTAL on line 22 on the 1040 for his income.

For current income he uses the Gross amount.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Sorry but I am confused. I won't have the 2011 tax return for my interview and I know that the deadline to file with the IRS is April 15th. My interview is on the 25th of April in Montreal. I have the completed tax return for 2010. The accountant will not have finished 2011 by the time I go for my interview. I am wondering if the interviewer will accept the tax return for 2010 as his taxes for 2011 are not complete hence the extension. The only reason that I am asking is because my interview is so close to the tax deadline. If the 2010 return is not sufficient as current tax information then I will bring the IRS Form 4868 and a copy of his 1040, along with tax transcripts for 09 and 10 instead of tax transcripts for 08 and 09.

Hope I was able to explain myself a bit better. Packet 4 from Montreal has asked for both I134 and I864 for K1 interview.

The deadline to file the 2011 income tax return is April 17. Your fiancé's accountant needs to supply a copy of the extension request for you to take to the interview in addition to the previous year's tax transcripts.

We may also have to use a co-sponsor. This would be my older sister who is a US citizen. She live in CA and my fiance lives in NY. Is this going to be a problem that she lives in a different state? If not, what evidence will she have to provide and will proof of citizenship have to be provided?

If proof of citizenship has to be provided (GC) can she just send me a photocopy of her GC?

If your interview is before April 17th he is not required to have the 2011 returns. If it is after that date, you will have to take them to the interview. Because he filed an extension, extension IRS form 4868, the 1040 return for 2010 and the 2009 and 2008 transcripts.

As long as she's a USC, you'll be fine. She would also need to complete and sign a separate I-134 and provide supporting information confirming her income is above the poverty guideline for any dependents plus yourself. 2012 Poverty Guidelines: http://www.uscis.gov/files/form/i-864p.pdf

She can be co-sponsor as long as she meets the guidelines. It doesn't matter where in the US she lives. If she has a GC she is not a citizen, she is an LPR. She can still co-sponsor but she will need to check the box for permanent resident and a photocopy of her green card is fine. Just have her fill out another I-134 and send all her supporting documents. :thumbs: :thumbs:
