Hello! I just returned from Ecuador this weekend after visiting and becoming officially engaged to an ecuadorian man. A few weeks ago, he admitted that while living in Spain in 2008, he was given a citation for solicitation of a prostitute. I spoke to an immigration attorney before I left for Ecuador to see if that might hinder him from obtaining a K-1 visa. The consultation was free, therefore I got just a little information. The attorney said that it would be a good idea to marry my fiance first in the event that we would need to apply for a visa waiver ban (the embassy might be more willing to give the waiver to a married couple). Now my problem is finding a place where we can marry. To marry an ecuadorian in ecuador I would need to live there for at least 75 days - which I can not do for a few reasons. I don't know where we can find information about where he as an ecuadorian can travel (obtain a visa) so that we can marry quickly outside of ecuador. I checked Peru and it looks like they have the same kind of laws as ecuador as far as waiting time for marriage in that country.

Welcome, si man, and I'm extremely sorry to report that you'd eventually be dealing with the Guayaquil consulate.

Before you proceed, please read this thread in its entirety:

If the attorney to whom you spoke hasn't dealt directly with Guayaquil, his advice is worthless. In fact, if you were to marry in a third country, it could be viewed askance.

I wouldn't marry first in hopes that this would have a positive effect vis-a-vis the consulate. It won't. In fact, you won't have a prayer there unless you have a distinctly bona fide relationship with evidence thereof coming out of your "culo." Optimally, you should shoot for multiple trips and as much time as possible together, with thousands of fotos of yourselves in zillions of situations and knowing each other better than the backs of your hands. Of course, if you're not there during his visa interview, you're hosed.

You're in a great position in that you haven't filed any paperwork yet. I wouldn't, for many months. Showing a track record in regard to the relationship would give you a fighting chance, and the extra time would give your fiance the chance to keep his nose clean for even longer. You may not wish to proceed with the relationship at all, depending on what the Spanish police report says, because there might not be a prayer of procuring a visa.

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

we are trying to obtain that information. It was a civil citation rather then criminal, so I don't imagine it would have much information, but we will see
