I-751 For Step-Son

My step son will need to start the process of his I-751 in the late spring of this year. He is scheduled to return to the US from China at the end of July, which would be a late time for him to get the needed paperwork into USCIS. Can we (me and his mom) complete his paperwork and so forth while he is still out of the country? He is in college in China and it would be hard for him to leave before his term ends. Any advice would be greatly appreciated.

YOUR STEP SON WILL STILL NEED TO SIGN THE 751 FORM IF HE IS OVER 18 YEARS OLD. AFTER COMPLETING HIS 751 FORM, YOU CAN SEND IT TO HIM BY OVERNIGHT EXPRESS. AFTER HE SIGNS THE FORM, LET HIM MAIL IT BACK TO YOU BY OVERNIGHT EXPRESS AND THEN YOU CAN MAIL IT TO USCIS. TO MAKE SURE ALL OF THIS, GO TO THE USCIS WEBSITE FOR INSTRUCTIONS. I AM SURE THAT IF HE IS UNDER 18 YEARS OLD, HE DOESN'T HAVE TO SIGN IT UNLESS THERE IS A CERTAIN AGE THAT HE DOES HAVE TO SIGN IT. IT COULD BE 18 YEARS OLD OR MAYBE EVEN 17 YEARS OLD THAT HE HAS TO SIGN. GO TO THE USCIS WEBSITE UNDER INSTRUCTIONS FOR 751 PACKAGE.

Thank you so much for your reply and the time you spent...yes, he's 20 so I will do this. I suspected that he would have to sign and the USCIS does know that he's out of the country...no sense in taking chances. One more thing...can be Biometrics testing be postponed to a later date if needed? Thank you again...take care. Sincerely, Mark

We just did my step sons I130, no signature there, he will have to sign when he gets ready to come to US and biometrics, unless i missed the point?

Completely different process.

Since your step-son is in the initial immigration process his first biometrics will be at the US Embassy with his interview.

For I-751 (Removal of Conditions) Biometrics must happen before the application can be adjudicated. I've heard of overseas biometrics for spouses of military but I'd be surprised if that could be done in the OP's case.

You can file I-751 while out of the country, but you will responsible to fly to the US to attend all interviews, including biometrics.

make sure that any form requiring his signature - he signs in china, sends all back to you via EMS.

Original signatures are important.

IMO, try to submit the package about 5 weeks before his arrival date into the USA - the first biometrics should be right 'about' then.
