Hey everyone, My mom has a job for my husband we need to know if he can work. We originally thought that he couldn't work until we file for his EAD with his AOS but became confused because he was given his Employment Authorization number at his point of entry from an officer. Why would he have an EAD number given to him if he is not suppose to work?

I really just want to hear from people who have experience with receiving an EAD number at a K-1 point of entry

He cannot work with that unfortunately. The CBP officer was in error. Look at the work requirements in the I-9 form - you will see is not authorized to work.

Is that really and EAD number or an EAC number which means petition was processed through Vermont ?

No. That is only valid if used with a work visa, the K-1 is not a work visa. Get married and file for AOS along with an EAD. When you get the EAD in your hand you can work.

Read the documentation requirements on the I-9 form.

What you have is an I-94 with an "employment authorized" stamp, the number is the I-94 number. Probably from JFK who give that to everyone. They gave one to our 13 year old K-2 son when he arrived, I told him it meant he had to work in a coal mine to pay for school. :whistle: Since the stamp itself mans nothing without other proper documentation the people at JFK just stamp them all and let someone else sort it out.

It is meaningless. It has no value without a work authorized visa which the K-1 is not (I know, the SS office says it is but that is only so you can get an SSN which was required by some states to get a marriage license) No one at the POE has the authority to issue a work authorization.

K-1s cannot work without an EAD, what you have is NOT an EAD

He entered at san antonio and the back of his I-94 says "Employment Authorized EAD 8C_R_7_a.1_". We are married already and just recieved our marriage certificate in the mail yesterday so I will be filing the AOS today. It's not a stamp, just hand writen number by the officer at POE.

I never saw that before. You got me. Did he previously have some other work authorization that may still be valid? It K-1 is simply NOT work authorized so where this comes from for an I-94 is beyond me. Unless he previously was here and authorized to work, that would not change because of a K-1

No he was here on a B1/B2 when he came here the first time.

Thanks for your help, I have seen many of your posts and trust your advice. I think we will see if he can volunteer for the next few weeks so he can secure the position while we wait for the official stuff.
