Hi everyone, i have an AOS application pending with the USCIS, however, 2 days ago i received an RFE letter in the mail asking for more financial evidence. The letter said, " Based on the documents submitted with the Form I-864, Affidavit of Support, for the petitioner/sponsor, the net value of the assets does not make up the difference between the petitioners/sponsors income and the poverty guidelines. Submit evidence of assetsthat meet the standards listed below or obtain joint sponsor."

NOW, we already fied the affidavit of support with a joint sponsor, who in our case is my father in law...however, we only submitted his tax return...it was not a W-2 and not sure if it was a 1099 or a tax schedule because it was just what he gave us. and teh second thing was his job letter. The tax document and the job letter clearly showed that he made well over $40,000. but we did not submit anything else. now my question is did they send us the RFE because it was an incomplete I-864 from our joint sponsor ? and now what do we do? has someone else here gotten a similar RFE? please share your suggestions. thank you.

Resubmit with every supporting document for the taxes. You should have kept a copy. You will need it for your interview. Did you send a cover letter with your submission? Every piece of income document and worksheet that supports the tax is important. Just send what they ask for and do it ASAP. Don't just accept what is given, you need to know what is to be submitted; it will prevent further RFEs. All the best

For a joint sponsor, they need to show they have enough for themselves, spouse, any dependent children, other dependents listed on their taxes, plus the intending immigrant. If his $40,000 covers that, then he should be accepted as the joint sponsor for you. Go over his form and make sure it is filled out correctly. He will need to provide a letter from his employer stating his position and salary, tax transcript from the IRS for the most recent tax year (or a complete copy of his return including all forms, schedules and attachments plus any W-2s and/or 1099s), plus proof that he is a USC or LPR(copy of birth certificate, naturalization, bio page from US passport or front and back copy of green card).

Check over all the documents to be sure everything is correct and the amounts are enough to qualify. http://www.uscis.gov/files/form/i-864p.pdf

Resend all your documents plus his with your RFE. State on the cover letter for your RFE that you are using a joint sponsor and his documents are included.

thank you guys for ur responses.. yeah we will definately submit the required documents... but do i just send in a complete I-864 Affidavit of support from our joint sponsor or do i send in my husband's package of I864 again as well? meaning do we send in both affidavit of sippuorts , one from my husband n then one from my joint sponsor? or just from the joint sponsor?

our joint sponsor has no dependents so the $40k he makes are just for himself and enough to cover us as a joint sponsor. n yeah i will def. ask him to give us all those docs. i just hope he has them its just awkward to ask him for all those things all over again n he lives kinda far too. but thank you for ur advice.
